New Federal Government Law for Electric Cars in SP Includes New Adaptations in Buildings

New buildings constructed in the city of São Paulo (SP) will have to provide an electric car charging system starting next Wednesday (31) under a new requirement from the federal government. The requirement applies to commercial and residential building projects registered with the city hall starting on that day, meaning that ongoing constructions do not need to include the electric car service or make adjustments.

The federal law requires that the measurement of electricity consumption used for each electric car must be individualized. The charging for the use is not detailed in the legislation but may occur at the time of charging or appear on the condominium bill.

The new federal law in SP is expected to affect more than 1,000 new building projects targeted at classes A and AB and constructed over the next five years in SP. The project was developed by Zletric, one of the companies that installs electric car charging systems and is already seeing a high demand for the service.

Zletric’s executive director, Pedro Schaan, explains: “In the condominiums that are already altering their projects to comply with the federal government law, the company is installing charging points in the common areas of the buildings. The energy fee is paid only by those who charge their cars, even though it is installed in a common area.”

New Federal Government Law System in SP May Be Expensive

The prices of an electric car charger range from R$ 6,000 to R$ 10,000, according to Schaan. It would be necessary to spend between R$ 36,000 and R$ 60,000 to serve, for example, all residents of a condominium of six buildings.

There is also the possibility of renting the system for an average of R$ 200 per month per charging point. In this case, the corresponding energy charge appears directly on the electricity bill, as the rental is for individuals.

Despite the costs, the possibility of an increase in the prices of new apartments and even rents is refuted by Secovi-SP.

Vice President of Technology and Sustainability at the union, Carlos Borges, explains: “The law does not quantify the expenses of the construction companies. I do not believe there will be a pass-through to consumers. In terms of rental, yes, there could be an increase, but it is very difficult because there are currently very few electric cars on the road in the country.”

Buildings Exempt from the Requirement

 Projects built from public housing programs or subsidized with government funds, provided that technical or economic impossibility is proven, will not be required to provide electric car charging services.

Borges states: “The law excludes popular housing, which is correct since this type of vehicle is very expensive, as well as excludes buildings that are already constructed due to the difficulty of adapting various edifices.”

Last year, 6,850 electric cars were purchased in the state of São Paulo, according to ABVE. A large part of these vehicles are called hybrid vehicles, allowing for switching between the electric system and combustion. Currently, over 40,000 electric cars are circulating in the country, and the expectation is that the number will rise to 1.5 million by 2030, according to ABVE.
