Brazilian Drivers May Face the Nightmare of the Roads! A New Bill Brings Fines of R$ 2,934.70 and Up to 12 Months of CNH Suspension. With the Risk of Being Out of the Highways for 2 Years, the New Rules Seek to Reduce Accidents and Strengthen Safety on the Roads.

The Bill 1405/24, currently under analysis in the Chamber of Deputies, proposes significant changes to the Brazilian Traffic Code (CTB).

The initiative aims to classify dangerous overtaking or reckless driving that puts people’s lives at risk as a severe violation, establishing more severe penalties for such behaviors.

What Are Dangerous Overtakes and Reckless Driving?

According to the bill, dangerous overtaking or reckless driving are defined as maneuvers that do not comply with traffic regulations and pose an imminent risk to road safety and the physical integrity of individuals.

The intention is to curb practices that could result in serious accidents, protecting all road users.

Proposed Penalties

The bill establishes a fine of R$ 2,934.70 for violations classified as dangerous overtaking or reckless driving.

This amount corresponds to ten times the base value of a severe violation.

Additionally, the violating driver will have their right to drive suspended for 12 months and will receive seven points on their National Driver’s License (CNH).

In cases of recidivism within one year, the suspension will be applied in double.

Furthermore, drivers penalized for this infraction will not be able to drive on highways or roads for a minimum period of two years, starting from the date of the violation.

This measure aims to reinforce the seriousness of the infraction and discourage reckless behaviors on the road.

Impact of Dangerous Overtaking on Brazilian Traffic

Overtaking in prohibited areas, at high speeds, or without due caution presents a significant risk not only for the driver but also for all road users, including passengers in other vehicles and pedestrians.

According to data from the Ministry of Health, in 2022, 33,894 people lost their lives due to traffic accidents in Brazil.

Although there is no specific statistic on dangerous overtaking, experts point out that this maneuver is among the main causes of fatal accidents on Brazilian roads.

The Federal Highway Police (PRF) emphasizes that many of these collisions occur on single-lane highways, where the risk of dangerous overtaking is even greater.

Studies indicate that about 30% of deaths on federal highways involve head-on collisions, many of which are caused by improper overtaking.

Arguments in Favor of Stricter Penalties

Deputy Clodoaldo Magalhães, the author of the bill, highlights that the tightening of penalties is a necessary response to reduce the high rate of fatal accidents in the country.

He points out that Brazil is among the countries with the deadliest traffic conditions in the world, and more stringent measures are essential to ensure safety on the roads.

Other experts agree with the initiative, stating that increasing penalties can have a deterrent effect, causing drivers to think twice before performing dangerous maneuvers.

Data from the World Health Organization (WHO) indicate that countries that have tightened their traffic laws have seen significant reductions in accident numbers.

What Is Needed for the Bill to Be Approved?

For Bill 1405/24 to become law, it needs to be approved conclusively by the Committees on Transport and Traffic, and on Constitution, Justice, and Citizenship.

After this stage, the proposal must be approved by the Chamber of Deputies and the Senate.

The bill’s progress is closely monitored, given its relevance to road safety in the country.

Importance of Traffic Education

In addition to harsher penalties, experts emphasize the importance of investing in traffic education.

Educational campaigns and driver training programs can contribute to raising awareness about the risks of dangerous overtaking and reckless driving, promoting safer behavior on the roads.

Countries like Sweden and the Netherlands, which have adopted traffic education programs from early childhood, have much lower rates of fatal accidents.

Experts believe that for the new measures to have a real impact, they must be accompanied by educational initiatives and rigorous enforcement.

According to experts, Bill 1405/24 seeks to tighten penalties for dangerous overtaking and reckless driving, promoting safer and more conscious traffic.

The proposal reflects a growing concern for road safety and the need for stricter measures to deter practices that put lives at risk.

If approved, the bill could represent a step forward in Brazilian traffic legislation, helping to reduce the number of fatal accidents.

The combination of harsher penalties, traffic education, and effective enforcement may be the key to safer traffic for everyone.

Acho essa lei essencial para reeducação no trânsito. Pois passei por uma situação na qual outro veículo de carga realizava uma dessas ultrapassagem irresponsável,onde eu e outro motorista
quase perdemos a vida por irresponsabilidade de um imprudente.

A maioria desses acidentes envolve o consumo de bebida alcoólica,deviam endurecer sim e aplicar a lei para quem ingerir bebida alcoólica e dirigir,pois está assumindo o risco de causar um acidente q na maioria das vezes é fatal.
Prq logo o povo já não c assusta mais em beber e dirigir,prq sabe q c causar um acidente ou for pego em uma blitz vai pagar um valor e volta pra casa como c nada tivesse acontecido.Todos os dias c vêem acidentes fatais por causa da ingestão de bebida alcoólica, famílias sendo despedaçadas por uma atitude de um serviço irresponsável.
