The Superior Labor Court (TST) imposed fines on the unions totaling 58.5 million reais to be paid to Petrobras during the strike of oil workers that ended last Friday, February 21. The calculation of the fine took into account only 13 of the 20 days of the strike.

Initially, the daily fines set by the TST were R$ 500 thousand for large unions and R$ 250 thousand for smaller ones. However, after 5 long hours of negotiation between Petrobras and the unions, they reached the new agreement of 2.47 million to be paid to Petrobras.

The penalty imposed by Minister Gandra of the TST at Petrobras’s request on the 4th took into consideration the fact that the strike did not comply with the minimum percentage of workers on duty, set at 90%.
The agreement took place during the conciliation meeting between the state company and the unions, which ended the strike of oil workers, mediated by Ives Gandra, Minister of the Superior Labor Court (TST).
Petrobras is authorized by the TST to withhold part of the money related to union fees deducted from workers’ salaries, which was previously meant to be fully transferred to the associations.
The state company may deduct half of the days not worked by striking participants, while the other half will be compensated through time banks within a maximum period of 180 days.
The state company took into account the workers’ request for the shift schedule to be established according to the convenience of the employees.
Petrobras may maintain the current schedule for 25 days. This period starts from the date when the agreements regarding the new schedules will be signed, with the aim for the signing to occur on the 27th.
New Negotiation Between Petrobras and Unions Will Occur on the 27th
According to unions and oil workers, the main reason that led to the strike was the dismissal of 400 workers from Araucária Nitrogenados (Ansa), a subsidiary of Petrobras located in Paraná.
The first layoffs at Ansa were set to happen on February 14. However, negotiations regarding this impasse did not occur in the agreement on Friday (21).
Unions and Petrobras will meet to negotiate exclusively the situation of Ansa on the 27th.
A representative of the National Federation of Oil Workers (FNP), Adaedson Bezerra da Costa warned that the “state of strike” is permanent. In other words, if the category feels that the state company will violate other points of the collective agreement, the workers may strike again.
“We agreed to end the strike, with everyone working, but the state of strike is permanent,” he said. “The management of the Petrobras system is coming to fulfill the collective agreement,” said the representative of the Unified Federation of Oil Workers, Deyvid Bacelar.
