ANP board approves the first proposal, presented by Petrobras, in the amount of BRL 855 million
The ANP (The National Agency for Petroleum, Natural Gas and Biofuels) has already received 25 proposals from oil companies with an interest in memorizing terms of adjustment of conduct (TAC), to convert fines for non-compliance with local content requirements into new investments in goods and services in the national industry. The added orders result in commitments of R$ 1,887 billion.
The board of the National Petroleum Agency approved on Thursday (14/7) the first proposal, presented by Petrobras. The request covers blocks and fields of operation solely by the state-owned company. These are exploration and production contracts that have been extinguished or whose phases have ended.
Petrobras will invest, until 2026, BRL 855 million in goods and services for the national industry
Petrobras is committed to investing BRL 855 million in goods and services for the domestic industry by 2026, with certified local content.
The transformation of fines into new investments is provided for in ANP Resolution No. 848/2021. Under the terms of the resolution, the value of commitments in new orders will be equivalent to 100% of the value of the fine.
According to the ANP, the 25 requests for signing the TACs — which were received by July 13, 2022 — include 26 companies (in consortium or in participation in individual projects). They come from 42 notices of infraction related to 53 exploration and production contracts. It was confirmed by the agency that expects to receive new applications.
The celebration of the agreement is optional. Based on the resolution, the term of commitment replaces sanctioning administrative processes – which are now archived.
The proposals received by the National Petroleum Agency are now being analyzed. The agency will assess the “feasibility and reasonableness of the deadlines”.
After manifestation of the Federal Prosecutor's Office with the regulatory body, they will be forwarded to the board for deliberation.
