MPRJ and MPF Request Revocation of the License for Jaconé Port in Maricá, Thus Blocking the Liquid Bulk Terminal and Ponta Negra Shipyard
INEA (State Institute of the Environment) filed on Monday (03/25), a request from the Public Ministry of the State of Rio de Janeiro (MPRJ), through the Specialized Action Group in Environmental Matters (GAEMA/MPRJ) and the Regional Prosecutor’s Office of the Republic 2nd Region (MPF) for the revocation of the Preliminary License issued for the Jaconé Port project in Maricá, where the Liquid Bulk Terminal and Ponta Negra Shipyard (TPN), on the beach of the same name.
The Impasse
The installation license request for the TPN was under review by INEA; there was only a preliminary license, as MPRJ had pointed out flaws in the licensing.

According to MPRJ, INEA should not have postponed various studies according to environmental norms, until after the preliminary license.
This preliminary license was heavily criticized, as the location is inadequate for the proposed project, as well as its urban, environmental, cultural, and social planning.
Many other violations in the licensing were found by MPRJ, all of which are contrary to articles 5 and 6 of CONAMA Resolution No. 01/86, article 8 of CONAMA Resolution No. 237/97, as well as violating articles 1 and 2 of State Law No. 3.111/98 and articles 5 and 2 of Municipal Law No. 2466/2013.
The MPRJ Civil Inquiry No. 2012.01339146, which initiated the ministerial measure, conducted various critical technical analyses of the referred environmental licensing, through GATE/MPRJ, and proposed an Administrative Improbity Action, two Representations for Unconstitutionality, a Criminal Action, and a Public Civil Action for the Protection of Natural Cultural Heritage, the latter existing since 2015.
Macaé Port vs. Maricá Port
The project for TEPOR (Macaé Port Terminal) also faced impediments from an environmental agency in São Paulo and was accepted in civil court a few months ago, despite all the environmental licenses issued.
Indirectly, the ports of Macaé and Maricá are in a silent dispute to win logistics contracts in the oil and pre-salt sector; in theory, the first to build its port will hold the best shares and revenues from these activities in the Santos and Campos Basin.
