Bill Proposes To Eliminate Driving School Requirements In The CNH Issuance Process Through Private Instruction

If the New Bill Is Approved, The Future Driver Will Have a New Option to Issue Their CNH Through a Faster and Cheaper Process        

Deputy Kim Kataguiri, aiming to make the process of issuing the National Driver’s License (CNH) less time-consuming and cheaper, created Bill No. 4474/20, which provides for the authorization of lessons and practical exams conducted by independent instructors, as long as they are accredited, as an alternative to traditional driving schools. The Bill from Deputy Kim Kataguiri aims to make attendance at driving schools optional for obtaining the National Driver’s License (CNH). The bill is currently under analysis in the Chamber of Deputies, as what the text proposes will cause changes to the Brazilian Traffic Code.

According to explanations from Deputy Kim Kataguiri (DEM-SP), the bill will allow the instruction of future drivers to be conducted privately, without the student having to go to a traditional driving school. According to the deputy, the main objective of this measure is to reduce all the bureaucracy of the CNH issuance process, in addition to making it less costly.

Operation of Classes After Approval of the Bill

If approved, the practical driving test may be conducted on public roads, with all assistance and instructions being provided by an independent instructor, as long as they are accredited by other traffic authorities.

The accredited instructor must hold their National Driver’s License corresponding to the category desired by the future driver for at least five years after obtaining the provisional CNH, plus not having been penalized in the last five years, without having their CNH suspended or revoked, where they lose the right to drive temporarily or permanently.

The instructor must also have no ongoing legal proceedings against them for such penalties and must not have been convicted or prosecuted for any traffic crimes. The vehicle used during the instruction process for the future driver must have its own identification as a learning vehicle, and it must also be properly registered and in conditions to operate on public roads, according to the regulations established by the National Traffic Council (Contran).

Bill Will Help Future Drivers, But Does Not Aim to Eliminate Traditional Driving Schools

As of the latest update, the Bill that envisages the elimination of requirements imposed by driving schools was made in mid-December 2020, when it was attached to 3181/12.

The proposal is being processed along with over 200 other bills that amend the Brazilian Traffic Code (PL 8085/14 and attached). It is important to note that the bill in question does not aim to end driving schools, but rather to provide a new option for the future driver, who may choose to proceed with the traditional process or prefer the new independent learning modality.
