The year 2025 arrives bringing important changes to the Brazilian Traffic Code (CTB), and drivers of various categories need to be careful not to suffer serious penalties.

While many are familiar with the basic rules, recent changes can surprise even the most experienced drivers. What has changed?

How do these rules impact the daily lives of those who use the National Driver's License (CNH) to work? Find out everything below!

Changes to the mandatory nature of the EAR

Professional drivers, such as app drivers, taxi drivers and school transport drivers, now face greater rigor regarding the requirement to include the inscription “Exerce Atividade Remunerada” (EAR) on their driver's license.

According to the National Traffic Council (Contran), failure to observe this is classified as a very serious infraction, with a heavy fine and even the possibility of having the vehicle towed.

This measure seeks to ensure that drivers are properly registered and qualified for professional activities in traffic.

For many, non-compliance can mean a disruption in work and financial losses.

Who needs the EAR on their driver's license?

The inclusion of the EAR observation on the CNH is mandatory for several categories of professionals. According to the regulations in force, the following must meet this requirement:

  • Drivers of transportation applications;
  • taxi drivers;
  • School transporters;
  • Motorcycle couriers;
  • motorcycle taxi drivers;
  • Passenger and cargo transport drivers.

The objective is to ensure that these drivers have the necessary training and meet the legal criteria to carry out their activities safely and responsibly.

How to regularize your driver's license with EAR?

Regularizing your driver's license with the EAR registration is a relatively simple process, but it involves mandatory steps. Interested drivers must:

  1. Access the Department of Transportation (Detran) portal of the state of residence;
  2. Request the inclusion of the EAR observation;
  3. Carry out a psychological evaluation with an accredited professional;
  4. Pay the corresponding fees.

Psychological assessment is an essential requirement and seeks to ensure the driver's ability to face daily challenges in traffic.

The fees charged are divided between the costs of the assessment and the issuance of the updated CNH.

Regularization costs

The costs for adding the EAR to the CNH have been adjusted in recent years and may vary from state to state. Between 2022 and 2023, the costs were as follows:

  • Psychological assessment: R$123,08 (2022) and R$131,90 (2023);
  • Issuance of updated CNH: R$ 116,50 (2022) and R$ 124,06 (2023).

Although the 2025 figures have not yet been officially released, it is important that drivers include these expenses in their financial planning to avoid surprises.

Benefits of EAR annotation

In addition to the legal requirements, there are specific advantages for drivers who have an EAR observation. One of the most notable is the more flexible scoring system.

While ordinary drivers may have their driver's license suspended reaching thresholds ranging from 20 to 40 points, those with EAR have a fixed ceiling of 40 points.

Another important benefit is the possibility of clearing your record by participating in refresher courses.

According to Law 14.071/20, professional drivers can reset their score when they reach between 30 and 39 points, as long as they meet the legal requirements.

In practice, this allows drivers to accumulate up to 78 points per year without losing their license, as long as they follow the recycling rules.

Impacts of changes for professional drivers

The new rules aim to offer greater protection and flexibility for professional drivers.

Recognizing the importance of the CNH for the livelihood of these people, Contran created measures that balance rigor and viability.

This allows drivers to continue operating even after minor infractions, as long as they meet the requirements and go through the retraining processes, when necessary.

Furthermore, the changes reinforce the commitment to safety on the streets, encouraging drivers to regularize their situations and adopt more conscious practices in traffic.

Why are these changes important?

The changes to the CTB and the EAR requirements are not just bureaucratic, but reflect an attempt to further professionalize Brazilian traffic.

They ensure that drivers are fit to perform their duties and, at the same time, protect both drivers and passengers.

With this, Brazil takes a step forward in the search for safer, more efficient traffic aligned with the needs of workers who depend directly on the CNH.
