Professions Exposed to Physical, Chemical, or Biological Risks Continue to Have Access to Special Retirement. Understand the Changes in the Law and How to Take Advantage of This Benefit

Did you know that there are professions in Brazil that allow you to retire up to 10 years earlier than other workers? That’s right: those who work in environments considered unhealthy or dangerous can secure the right to what is called special retirement, a benefit provided by law that has undergone significant changes following the 2019 pension reform.

In this article, we will explain in detail what special retirement is, who is entitled to it, what the current criteria are, and how this type of retirement can be a real alternative for those working exposed to health risks.

What Is Special Retirement?

Special retirement is a type of benefit granted by INSS (National Institute of Social Security) to workers who engage in activities with continuous exposure to harmful physical, chemical, or biological agents, at levels that harm health or physical integrity.

It was created with the aim of protecting professionals who, even contributing to social security like any other worker, face greater wear and tear throughout their lives due to the dangerous or unhealthy nature of their work.

Until the Pension Reform, which took effect in November 2019, workers could retire after 15, 20, or 25 years of contributions, depending on the risk of the activity — without a minimum age requirement. This changed with the new rules.

What Changed With the Pension Reform?

The reform brought a new requirement: now it is necessary to meet a minimum age, in addition to the time exposed to risk. Here’s how it looks now:

  • High Risk (e.g., underground mining):
    • 15 years of special activity + 55 years of age
  • Moderate Risk (e.g., heavy chemical industry):
    • 20 years of special activity + 58 years of age
  • Low Risk (e.g., healthcare professionals, electricians, armed guards):
    • 25 years of special activity + 60 years of age

In other words, those exposed to low risk can still retire 10 years earlier than the minimum age for regular retirement, which is 65 years for men and 62 for women.

Transition Rules: Who Was Already in the Market Before the Reform

If the worker was already contributing before the reform but had not completed the old requirements, they can opt for one of the transition rules:

  • Points System: sum the age with the contribution time.
    • 66 points (for those who worked 15 years in special activity)
    • 76 points (20 years of special activity)
    • 86 points (25 years of special activity)

This system still allows many professionals to retire before age 60, especially those who started working early in unhealthy environments.

Which Professions Are Entitled?

It is not the profession that guarantees the benefit, but rather the work environment and the proven exposure to harmful agents. Some of the most common categories that are entitled include:

  • Workers in underground mining
  • Welders and boilermakers
  • Electricians exposed to high voltage
  • Nurses, nursing technicians, and laboratory professionals
  • Drivers and ticket collectors (in some cases)
  • Armed guards
  • Firefighters and prison agents
  • Construction workers exposed to chemicals

The complete list is in the annexes of Decree No. 3,048/1999 and can be consulted directly on the INSS website.

How to Prove the Right to Special Retirement?

The main document required is the Social Security Professional Profile (PPP). It must be provided by the company and should contain:

  • Worker’s labor history
  • Description of the harmful agents to which the worker was exposed
  • Results of environmental technical reports
  • Information about the use of PPE (Personal Protective Equipment)

If there is any doubt about the authenticity of the information or if INSS denies the request, it is possible to file a administrative appeal or seek judicial support, especially if the technical report proves the risk.

Is It Worth Seeking This Type of Retirement?

Yes, especially if you already have more than 10 years in special activity and plan to financially plan. Even with the minimum age requirement, special retirement still represents a significant advantage.

In addition to retiring earlier, the calculation of the benefit amount is generally more advantageous: the worker can receive up to 100% of the average of their contribution salaries, without the reductions applied to regular retirement.

What If the Company Refuses to Issue the PPP?

Unfortunately, this is a common problem. The worker can:

  • Formally request the PPP in writing
  • File a complaint with the Ministry of Labor
  • Seek a lawyer to legally compel the issuance of the document
  • Use other evidence, such as expert reports and testimonies

According to specialists, the courts often recognize the right to special retirement even when there are difficulties in obtaining documentation, as long as there is robust evidence of exposure to risk.
