Bill 3300/2025 May Transform the CDC and Give Consumers the Right to Exchange Products Within 30 Days Even Without Defect. Understand the Impact.

In July 2025, the Senate began analyzing Bill 3300/2025, which may mark one of the most profound changes to the Consumer Protection Code (CDC) since its creation in 1990. The text provides that consumers will have the right to exchange products within 30 days, even when there are no defects, as long as they are in perfect condition. Bill 3300/2025, authored by Senator Flávio Bolsonaro (PL-RJ), expands the right to exchange products purchased in physical or virtual stores.

The proposal arose from the need to update Brazilian legislation in light of new consumption patterns, especially in e-commerce, where dissatisfaction with a product can go far beyond manufacturing defects.

What the Current Law Says and Where the Gap Is

Today, the CDC guarantees three main situations for exchange or return:

  • Defective or Apparently Flawed Product: 30 days for non-durable goods and 90 days for durable goods;
  • Repair or Replacement in case of proven hidden defects;
  • Right to Regret of 7 Days, applicable only to purchases made outside of a physical store, such as online or by phone.

In other words, if a consumer buys a product in a physical store and simply regrets it, there is no legal right to return. Many chains offer this possibility as part of their commercial policy, but not as a legal obligation.

What Changes with Bill 3300/2025

If approved, the bill will require businesses to accept returns and exchanges for simple regret, within 30 days, even without defects. The consumer will be able to choose:

  • to exchange for another product,
  • to receive store credit, or
  • to be fully refunded.

This new right will apply to any type of purchase, whether in a physical or online store, creating a level of protection previously unseen in Brazil.

Impacts for the Consumer: More Security and Confidence

For consumers, the measure represents a historic advance. Returning without justification will cease to be a concession from retailers and become a universal right.

This means that purchasing an appliance, clothing, or even furniture will have an extended reflection period, strengthening trust in the consumer relationship. Experts point out that this type of rule is already applied in European Union countries and in major U.S. retailers, where product returns are a well-established practice.

The Burden on Retail and the Challenges for Commerce

If consumers gain, retailers see risks. Associations like the CNDL and Fecomércio claim that the change may generate additional costs for retailers, especially small businesses, which will have to deal with frequent returns, reprocessing of products, and margin declines.

There is also fear of abuses, such as customers buying items for temporary use and then returning them.

However, market experts assert that the rule could have a positive long-term effect: more trust leads to more spending, and companies that adapt can retain customers at an unprecedented level.

The View of Jurists and Consumer Advocates

Consumer rights jurists view the bill as a civilizational advance, akin to the creation of the CDC itself in 1990. For them, the law should reflect a new consumption landscape where satisfaction and trust carry as much weight as the absence of defects.

The Idec (Institute of Consumer Defense) and Procon-SP have already expressed support for the project, highlighting that the 30-day period aligns Brazil with global practices and reduces the imbalance of power between companies and customers.

The Legislative Process and Next Steps

Bill 3300/2025 is still in the early stages in the Senate and will go through analysis in committees before reaching the floor. If approved without changes, it will proceed to presidential sanction. If there are alterations, it will return to the Chamber of Deputies for further consideration.

The debate promises to be intense, with strong pressure from retail entities against the text and mobilization of consumer advocacy groups in favor. Expectations are that the proposal will be one of the major legislative battles of 2025 in the economic and social spheres.

Bill 3300/2025 could become a turning point in consumer rights in Brazil. For the first time, the law would recognize the broad right of regret, ensuring up to 30 days for product exchange, even without defect.

The change promises to strengthen consumer confidence, increase competitiveness among companies, and stimulate a more transparent market. At the same time, it poses challenges for retail, which will have to adapt its logistics and customer service strategies to absorb the impact.

The big question remains: is Brazil about to usher in a new era of consumer protection, or will this achievement create shockwaves for retailers and small entrepreneurs?
