New Law Expands Official Assessment and Strengthens Protection for People with ASD
Law 15.256/25 was enacted this Thursday (13), and thus expands the diagnosis of Autism Spectrum Disorder (ASD) to adults and the elderly, while strengthening national guidelines. President Luiz Inácio Lula da Silva enacted the law, and in doing so, the National Policy for the Protection of the Rights of Persons with ASD now incorporates new actions aimed at lifelong diagnosis.
The change amends Law 12.764/12, which also gains a new section dedicated to encouraging expanded diagnosis, thereby addressing a historical gap in the assessment of adults and the elderly.
Legislative Origin and Foundations of the Proposal
Law 15.256/25 emerged from Bill 4540/23, by Zé Haroldo Cathedral (PSD-RR), who, in turn, advocated for the proposal as a commitment to inclusion and respect for diversity.
In 2023, Cathedral stated that existing policies were focused on childhood diagnosis, and thus the adult phase remained neglected, despite growing demands.
Thus, the approved text fills a recognized need by lawmakers, because it ensures that adults and the elderly can access formal diagnosis, which, indeed, did not occur adequately in the past.
Direct Impact on the Assessment of Adults and the Elderly
The expansion of diagnosis directly benefits people who have never received a formal assessment, especially because, previously, the lack of information led many Brazilians to receive incorrect diagnoses, such as anxiety, depression, or schizophrenia.
In this way, the law creates a more precise legal basis, as late diagnosis has always hindered access to specific public policies.
The IBGE states that 2.4 million Brazilians are diagnosed with ASD, and thus, the law can represent a step forward for those awaiting formal recognition, especially among adults and the elderly.

With the law, this structure changes, as the guidelines now encompass all age groups, thus reinforcing the national commitment to full inclusion.
Moreover, the law recognizes that diagnostic delays have caused emotional and social impacts, since many adults only sought help after years of unrecognized difficulties.
Repercussions and Expectations After Presidential Sanction
The enactment on November 13, 2025 reinforces the role of the State, as the expansion now officially integrates national guidelines, thus structuring a continuous policy of support.
Although the law is new, public sector specialists express expectations for structural advances, because the measure recognizes the importance of diagnosis throughout life.
Consequently, adults and the elderly now receive explicit protection, which aligns legislation with the real needs of the population.
