Prohibition of the Brazilian flag generates reaction in condominiums

In Serra, a condominium notified residents about the prohibition of fixing any type of flag in external areas of the units when there is visibility to common areas or the street.

The notice mentions the possibility of penalties in case of non-compliance with the rule provided in the internal regulations.

The measure provoked a reaction among residents, especially because of the World Cup, scheduled to start in June, and the 2026 elections, with the electoral campaign expected in August.

A resident, who asked not to be identified, stated that the condominium owners have the right to demonstrate patriotism.

For her, it makes no sense to prevent the display of the Brazilian flag on one’s own balcony during the World Cup or on national dates.

Debate also reached Vila Velha

In Vila Velha, the situation is similar. According to residents’ reports, some condominiums have already started discussing in assemblies whether the display of flags on facades should be allowed or restricted.

In these cases, the decision tends to go through an internal vote, as the facades of buildings are usually treated as part of the condominium’s collective visual area.

The debate gained momentum because the use of the national flag tends to increase during World Cup periods, civic holidays, and moments of political mobilization.

Internal rule cannot contradict federal law

The lawyer Cristiane Puppim, a specialist in Civil Law and Condominium Law, explained to Portal Tempo Novo that a generic prohibition of the Brazilian flag can be considered irregular.

According to her, Federal Law No. 5,700/1971 authorizes the use of the National Flag in patriotic demonstrations, including on private properties.

Therefore, condominium conventions and internal regulations cannot contradict federal legislation.

The lawyer stated that the manager can intervene in cases related to security, structural risk, or inappropriate alterations to the facade. Outside of these situations, a broad prohibition tends to be legally questionable.

Party flags are treated differently

Cristiane Puppim also explained that the understanding changes when the case involves party flags, candidates, or electoral demonstrations.

Since the facade is part of the building’s collective aesthetic composition, internal rules can limit banners, posters, and political-party materials.

Even so, the lawyer warns that there cannot be selective treatment or prohibition based on ideological positioning.

The rules, according to her, need to be technical, uniform, and applied equally to all residents.
