The lawyer Cristiane Puppim, a specialist in Civil Law and Condominium Law, explained to Portal Tempo Novo that a generic prohibition of the Brazilian flag can be considered irregular.
According to her, Federal Law No. 5,700/1971 authorizes the use of the National Flag in patriotic demonstrations, including on private properties.
Therefore, condominium conventions and internal regulations cannot contradict federal legislation.
The lawyer stated that the manager can intervene in cases related to security, structural risk, or inappropriate alterations to the facade. Outside of these situations, a broad prohibition tends to be legally questionable.
Party flags are treated differently
Cristiane Puppim also explained that the understanding changes when the case involves party flags, candidates, or electoral demonstrations.
Since the facade is part of the building’s collective aesthetic composition, internal rules can limit banners, posters, and political-party materials.
Even so, the lawyer warns that there cannot be selective treatment or prohibition based on ideological positioning.
The rules, according to her, need to be technical, uniform, and applied equally to all residents.
