The New Legislation Comes into Effect with the Promise of Expanding Social Policies for Children and Adolescents, Ensuring Greater Legal Security for Guardianship Councils and Strengthening the Capacity to Respond in Situations Requiring Immediate Intervention
The law that replaces the term “social service” with “social assistance” in the Statute of Children and Adolescents came into effect this Monday (24).
The Law 15,268 of 2025 was published in the Official Gazette and sanctioned by the Acting President of the Republic, Geraldo Alckmin.
The change occurs directly in the section that lists the responsibilities of guardianship councils, which are responsible for upholding the rights of children and adolescents throughout the country.

Origin of the Proposal for Children and Adolescents
The amendment originates from Bill 8,251 of 2017, presented by Congresswoman Maria do Rosário.
The text modifies the wording that authorizes the guardianship councils to request public services in the areas of health, education, social service, social security, labor, and security. With the new law, the term “social service” is replaced by “social assistance.”
Understanding in the Senate
In the Senate, the proposal was approved in a final vote by the Human Rights Commission in October, under the rapporteurship of Senator Fabiano Contarato.
According to him, the substitution of the term makes the legislation clearer and reduces potential interpretative doubts.
For the rapporteur, “social assistance” is a broader term and prevents requests made by guardianship councils from being denied due to a strict reading of the previous nomenclature.
Objective of the Change
The senator emphasized that the amendment does not represent a simple language adjustment.
The measure aims to avoid limited interpretations that could hinder the actions of the councils in demands related to the defense of children and adolescents.
With the new wording, the legislation provides greater security for the agency to request adequate services in public networks.
