Federation Requests Suspension of Toll on BR-163 Until CCR MSVia Completes Required Duplication in the Contract. Understand the Impacts of the Decision and the Next Steps for the Roadway Concession.

The BR-163, which runs through Mato Grosso do Sul from north to south, is essential for the transportation of agricultural cargo, commerce, and tourism.

In recent years, the administration of the roadway has generated intense debates, mainly regarding the obligations of the concessionaire CCR MSVia and toll charges.

Federation Demands Toll Suspension

The Feintramag MS/MT (Interstate Federation of Workers in the Transport of Goods in Mato Grosso do Sul and Mato Grosso) has requested an immediate suspension of the toll on BR-163/MS.

The request will be forwarded to the state government, the Legislative Assembly, and the Attorney General’s Office (PGR).

According to the federation’s president, José Lucas da Silva, the toll suspension should remain in effect until CCR MSVia fully complies with the obligations set forth in the contract renegotiation.

Duplication of BR-163 Is the Main Demand

The main requirement is the full duplication of the roadway, as stipulated in the renegotiated contract.

Over the next four years, the concessionaire is expected to duplicate 203 kilometers, but according to José Lucas, in 11 years of concession, only 150 kilometers have been duplicated.

Another issue pointed out by the federation is the lack of shoulders in sections after Dourados, increasing the risk of accidents.

In addition to duplication, the removal of the roadway from the urban perimeters of several municipalities is also an urgent demand to reduce fatal accidents.

CCR Collected Billions from Tolls

Since the beginning of the concession, CCR MSVia has collected approximately R$ 3.6 billion solely from tolls. In 2024, revenue reached R$ 229.2 million, according to the company’s own data.

The renegotiation agreement stipulates that the toll will gradually increase from R$ 7.52 to R$ 15.13 for every 100 kilometers.

BR-163 Auction Will Be Held Soon

The National Land Transport Agency (ANTT) announced that the BR-163/MS auction will take place soon, in a “competitive process” model.

The selection criterion will be the largest discount on the toll rate specified in the tender.

The new contract provides for a R$ 17.32 billion investment in works and improvements.

History of the Concession and Promises of Investments

CCR MSVia took over the concession of BR-163/MS in 2014, with the responsibility to manage, renovate, operate, and duplicate the roadway.

The BR-163/MS is 845 kilometers long and passes through 21 municipalities.

In November 2024, the concessionaire committed to duplicating 75 kilometers in the first three years of the new contract and 203 kilometers over the coming years, with an estimated investment of R$ 1.087 billion.

The contract also includes improvements such as third lanes, marginal roads, bypasses, walkways, and accesses, totaling an investment of R$ 9.29 billion by 2054.

Criticism of the Execution of Works

Despite the commitments made, only 150 kilometers have been duplicated in 10 years of concession.

The investment made so far has been R$ 2.1 billion, but the new renegotiation requires CCR MSVia to invest R$ 9.3 billion in the coming years.

The toll rate will gradually increase according to the works schedule:

  • Year 1: R$ 7.52 → R$ 10.06
  • Year 2: R$ 10.06 → R$ 12.60
  • Year 3: R$ 12.60 → R$ 15.13

Additionally, there will be a specific increase for duplicated sections and additional lanes.

CCR MSVia’s Justifications

The concessionaire justified the suspension of works in 2017, citing a 35% drop in forecasted revenue due to the economic recession.

At the time, it requested a contractual review and adjustments to financing conditions from ANTT.

Even without the duplication completed, the toll charges continued, under the claim that the roadway was being maintained.

Federation Demands Compliance with the Contract

The Feintramag MS/MT argues that the toll suspension is necessary until the concessionaire meets its obligations.

The federation also emphasizes that the duplication of the roadway is essential for the safety of drivers and the reduction of accidents.

The case of BR-163/MS illustrates the challenges of roadway concessions in Brazil, where the equation between toll collection and the execution of works directly impacts safety and economic development.

Esses pedágios, estão quebrando os caminhoneiros, com cobrança por eixo. E não resolvem, na melhoria da situação das estradas. Políticos precisam trabalhar mais, parar de aumentar políticos e Partidos, parar de só querer arrecadar tributos, e voltar com novo mutirão do DNER acabando, definitivamente, com todos esses pedágios capitalistas.
