Government Recently Published New Ordinance to Clarify Values and Rules of the Incarceration Aid, Reinforcing Low-Income Criteria and Combating Misinformation
The incarceration aid has once again become the target of misinformation on social media. Various contents have suggested values above reality. However, the government reinforces that the benefit has a ceiling set at a minimum wage and is only paid to the dependents of the insured while they are imprisoned.
When the insured leaves prison, the payment is automatically terminated. This explanation is not new, as the topic was previously addressed by the Brazil Against Fake program last year. Still, rumors continue to circulate.
Who Is Entitled
The incarceration aid is paid only to the dependents of INSS insured individuals who can prove low income and are serving time in a closed regime.

Since January 18, 2019, there have been no more grants for semi-open regime. Cases prior to this date remain valid.
Furthermore, the insured cannot be receiving salary from a company or benefits such as retirement, death pension, maternity salary, temporary disability aid, or retention allowance.
Incarceration Aid: Values Defined in Ordinance
Recently, the Interministerial Ordinance MPS/MF No. 6 was published. The document establishes that, starting from January 1, 2025, the value of the incarceration aid will be R$ 1,518.00.
This amount is applied only when the insured is in a closed regime and does not accumulate other benefits, such as retirement, death pension, maternity salary, or temporary disability aid.
Low-Income Criteria
For the purposes of granting, a low-income insured individual is considered someone whose average contribution salaries in the 12 months prior to imprisonment is up to R$ 1,906.04. This rule will also take effect on January 1, 2025.
Therefore, only dependents of insured individuals within this limit will have access to the benefit. This calculation follows the adjustment indices of the General Social Security System (RGPS).
Combatting Fake News
The government warns that false information about the values and conditions of the incarceration aid hinders the understanding of the population.
Moreover, it reinforces prejudices against a benefit that has strict rules.
Thus, reinforcing official data is essential to avoid distortions and ensure that only those who truly qualify receive the payment.
