Understand If Those Who Receive BPC/LOAS Will Be Entitled to Thirteenth Salary in 2025, Which Bills Address the Issue, and Which Benefits Are Already Guaranteed to Program Beneficiaries.
The Continued Cash Benefit (BPC), provided for in the Organic Law of Social Assistance (LOAS), is paid by the INSS and guarantees a minimum salary per month to elderly individuals aged 65 and older or to people with disabilities in a situation of social vulnerability.
Unlike pensions and retirements, the BPC does not require prior contributions to Social Security.
Its goal is to ensure a minimum income for those who cannot sustain themselves or cannot rely on family support. Therefore, it is considered an assistance benefit and not a social security benefit.

The Most Common Question: Does BPC/LOAS Entitle You to Thirteenth Salary?
Every year, the same question arises among beneficiaries and their families: do those who receive BPC/LOAS have the right to thirteenth salary?
The answer is no.
The benefit does not provide for the payment of a Christmas bonus, unlike the pensions and retirements from the INSS.
As it is an assistance aid, it is not linked to the social security rules that determine the extra payment at the end of the year.
Still, the discussion about including thirteenth salary for this group is not new.
There are bills in progress that seek to amend the legislation to grant the additional amount, but there is still no definitive approval.
What Is the Status of the Thirteenth Salary for BPC/LOAS Beneficiaries?
Currently, two proposals are under analysis in Congress: PL 4439/2020 and PL 2348/2022. Both address the creation of a thirteenth salary for those who receive the benefit.
In April 2024, the texts were unified and forwarded to the Commission on Social Security, Social Assistance, Childhood, Adolescence, and Family (CPASF).
So far, they remain under review, awaiting an opinion.
Therefore, there was no approval in 2025. The issue is still under discussion, but with no forecast of when — or if — it will be implemented.
Which INSS Benefits Already Guarantee Thirteenth Salary?
Although the BPC does not include this payment, the Christmas bonus is guaranteed for several pension modalities. Among them:
- Retirement by Age;
- Retirement by Time of Contribution;
- Special Retirement;
- Retirement Due to Disability (Permanent Incapacity);
- Compulsory Retirement;
- Pension for Death;
- Sickness Benefit;
- Accident Allowance;
- Maternity Salary;
- Family Allowance (when associated with retirement or pension).
The amount paid is proportional to the monthly benefit, divided into two installments — the first usually between August and September, and the second between November and December.
In some years, the government anticipates part of the payment for the first semester.
Other Rights Guaranteed to Those Who Receive BPC/LOAS
Despite the absence of thirteenth salary, BPC beneficiaries enjoy other important advantages. Among them are:
Discount on the electricity bill through the Social Electricity Tariff;
Priority in housing programs, such as Minha Casa, Minha Vida;
Access to free medications provided by the government, especially for the elderly;
Possibility of contracting payroll loans and INSS payroll cards, with installments deducted directly from the benefit.
These rights, combined with the monthly minimum salary, serve as a basic support to ensure better living conditions.
Difference Between BPC and Retirement
It is essential to clarify that BPC/LOAS cannot be converted into retirement.
While retirement depends on regular contributions to Social Security, the assistance benefit is granted regardless of contributions.
However, if a BPC beneficiary starts contributing to the INSS, they may later request retirement, as long as they meet the requirements.
In this case, they will need to choose between one or the other, as the law does not allow accumulation.
