What the Brazilian Traffic Code Says
The legal basis is in the Article 252 of the Brazilian Traffic Code (CTB), which addresses prohibited behaviors while driving. Item VI states:
“Art. 252 – Driving the vehicle using headphones connected to sound equipment or a mobile phone: Violation – medium; Penalty – fine.”

Intercoms: The Controversy of Connected Helmets
If the use of headphones is prohibited, the question arises: what about helmet intercoms? These devices, increasingly popular among motorcyclists, allow communication between the rider and passenger, as well as answering calls or receiving GPS directions.
The CTB does not explicitly mention intercoms, which opens the door for different interpretations among traffic authorities. In some states, authorities understand that they can be used as long as:
- they do not alter the structure of the helmet,
- they are approved by Anatel or Inmetro,
- and they do not completely isolate the driver’s ears.
In other places, the interpretation is more restrictive, considering that any sound device in the rider’s ears falls under Article 252, VI. This creates a real “legal vacuum,” leaving motorcyclists subject to various interpretations during inspections.
How Much the Violation Costs and Its Impacts
The fine of R$ 130.16 may seem small compared to other, more severe penalties, but the real impact goes beyond the wallet.
The 4 points on the CNH weigh on the driver’s record, and in cases of recurrence or accumulation, they can contribute to the suspension of the license.
Furthermore, in accident situations, the use of headphones can be interpreted as an aggravating factor of responsibility. In legal disputes or with insurance companies, this behavior can complicate the life of the involved motorcyclist even further.
The Real Risks of Using Headphones While Riding a Motorcycle
More than the fine, the greater danger lies in safety. The motorcyclist depends on all their reflexes to react to unforeseen events. With their ears isolated by music or phone calls, they lose the ability to perceive essential external sounds, such as horns, sudden braking, ambulance sirens, or the noise of a car in a blind spot.
Moreover, manipulating a mobile phone or device while riding is a source of distraction that multiplies the chances of accidents. The result can be a simple loss of balance at low speed or serious collisions on fast roads.
The Safe and Legal Alternative
For those who need communication on the move, the solution is to use approved intercoms properly fixed to the helmet. These devices allow interaction without completely obstructing hearing and, in many cases, are accepted by traffic authorities. Still, the motorcyclist must use them responsibly, without excessive volume and without diverting attention from the road.
Brazilian legislation is straightforward: using headphones on a motorcycle is prohibited and incurs a fine. Article 252 of the CTB leaves no room for doubt about this. Intercoms, on the other hand, remain in a gray area, with different interpretations depending on the location and how they are used.
In the end, more than avoiding a fine of R$ 130, the motorcyclist should think about their own safety. On two wheels, any distraction can be fatal. And when the law, safety, and common sense point in the same direction, the best choice is to ride with all senses free and alert.

A lei de trânsito não é clara totalmente , em muito muitos casos , ela restringi geral , sem noção de segurança , pois a proibição em geral , pode vim causar mais acidentes , tendo em vista que a educação no trânsito é bem fraca , onde é mostrado só em campanha de trânsito .
Precisam ter uma visão mais ampla e clara em questão de leis aplicada e não lei no nível ditador.
