Using the shoulder to escape traffic, make a quick overtaking, or even as an improvised parking spot are common practices, but extremely dangerous and illegal. The truth, as pointed out by the Auto Papo portal, is that most drivers do not understand the real purpose of this lane, leading to serious infractions and putting lives at risk. Understanding the rules of the shoulder is not only a way to avoid financial losses, but also a matter of collective safety.

The Brazilian Traffic Code (CTB) is clear in defining the shoulder as a part of the road, distinct from the lane for vehicles, exclusively intended for emergency stops, parking vehicles in specific situations, and the circulation of pedestrians or cyclists when there is no appropriate place for them. Using it for any other purpose is a violation of the law and creates a risky environment for everyone.

When Is The Use Of The Shoulder Really Allowed?

The main guideline is simple: the shoulder should only be used in emergency situations. This includes sudden mechanical problems (flat tire, electrical failure, etc.), running out of fuel, a traffic accident, or a health emergency with the driver or a passenger. In these cases, the vehicle must be immediately removed from the traffic lane to the shoulder to ensure the flow and safety of traffic.

Although the general rule is emergencies, the CTB provides for two very specific exceptions for the traffic of vehicles on the shoulder. The first is to access properties or make turns, that is, when the driver needs to slow down to enter or exit a lot adjacent to the road. The second, as highlighted by Auto Papo, is to wait for a safe opportunity to cross the lane when performing a U-turn or left turn, using the right shoulder as a waiting area.

Emergency Stop: The Correct Procedure To Avoid A Fine

Simply stopping on the shoulder for a valid reason is not enough to avoid a fine. It is essential to signal the road correctly to alert other drivers and prevent accidents. According to traffic legislation, when immobilizing the vehicle, the driver must activate the hazard lights immediately and position the signaling triangle at least 30 meters from the rear of the car.

If the stop occurs in a low-visibility area, such as a curve or under fog, this distance should be even greater. It is important to remember that the triangle is mandatory equipment. Its absence in the vehicle already constitutes a serious infraction, with a fine of R$ 195.23, five points on the driver’s license, and vehicle towing. Similarly, stopping on the shoulder and failing to provide adequate signaling is also a serious infraction, with the same penalties.

The Most Common Infractions And Their Financial Consequences

Many drivers confuse the permissions and end up committing infractions that weigh heavily on their pockets. One of the most common, according to Auto Papo, is using the shoulder as parking without a compelling reason. This practice is considered a minor infraction, resulting in a fine of R$ 88.38, three points on the driver’s license, and vehicle towing.

The penalties become much more severe for those who use the shoulder as a shortcut. Driving a vehicle on the shoulder is a very serious infraction, punished with a fine of R$ 880.41 (amount multiplied by three) and seven points on the driver’s license. Even worse is the situation of those who use the shoulder to make an overtaking: the infraction is also very serious, but the fine is multiplied by five, jumping to R$ 1,467.35, in addition to the seven points on the license.

Other Penalties You Need To Know

Infractions do not stop there. Remember the left turn maneuver that requires using the shoulder as a waiting area? Failing to use it for this purpose, crossing the lane abruptly, is classified as serious infraction. The penalty includes a fine of R$ 195.23 and the addition of five points to the driver’s license.

Finally, after resolving the issue that led you to stop, it is your responsibility to remove all signaling from the road. Leaving behind the triangle, branches, or any other object used to alert other drivers is considered a medium infraction. The offending driver receives four points on their license and a fine of R$ 130.16. Keeping the road clean and safe is everyone’s duty.
