On August 28, President Lula Authorized The Foreign Ministry To Activate Camex (Chamber Of Foreign Trade) To Begin Consulting On The Application Of The Economic Reciprocity Law Against The United States.

However, Even After This Action By The President, The Brazilian Government Decided Not To Activate The Newly Established Economic Reciprocity Law Against The United States, Even After The Imposition Of Tariffs Of Up To 50% On Various National Products.

The Vice President Of The Republic And Minister Of Development, Industry And Trade, Geraldo Alckmin, Stated That Brazil’s Strategy Will Be To Maintain The Path Of Dialogue And Institutional Mediation, Mainly Through The WTO (World Trade Organization).

The Statement Occurred On Monday (15), During The Valor 1000 Event Hosted By The Valor Econômico Newspaper In São Paulo.

We Will Not Respond With Retaliation. We Will Dialogue. We Believe There Is Still Room For Negotiation,” Said Alckmin, Indicating That, Even With Legal Support To Act Against The Americans, The Planalto Preferred To Preserve Open Diplomatic Channels With Washington.

Sectors Are Already Feeling The Effects Of The American Tariff

The Tariffs Imposed By The Donald Trump Administration Started Causing Immediate Losses In Brazilian Exports, Especially In Traditional Segments Of The National Agribusiness.

The Coffee Sector Was One Of The Most Affected By The 50% Tariffs. According To The Council Of Coffee Exporters Of Brazil (Cecafé), Exports Of Specialty Coffees To The U.S. Plummeted Almost 70% In August Compared To July.

Compared To The Same Month In 2024, The Decline Reaches 79.5%.

In Instant Coffee, The Numbers Are Also Concerning.

According To The Abics (Brazilian Association Of The Instant Coffee Industry), Sales To The American Market Fell 50.1% Compared To July And 59.9% Compared To August Of Last Year.

As A Consequence, The U.S. Lost Ground Among The Largest Buyers Of Brazilian Coffee And Was Surpassed By Various European Countries. Germany Became The Leading Destination For National Coffee.

In The Footwear Industry, The Impacts Follow The Same Trend. A Survey By Abicalçados (Brazilian Association Of Footwear Industries) Shows A 17.6% Retraction In Brazilian Exports To The U.S. In August, With A Revenue Loss Of 1.4%.

A Survey By The Entity Reveals That 73% Of Companies Have Already Reported A Drop In Revenue, 60% Face Order Cancellations, And Another 60% Report Delays Or Interruptions In Negotiations.

To Maintain Contracts, Half Of The Companies Have Granted Average Discounts Of 15% To American Buyers, While Some Have Resorting To Collective Vacations To Reduce Costs While Waiting For Signs Of Market Recovery.

What Is The Reciprocity Law And How Could It Be Used

Sanctioned In April 2025 As Law No. 15.122 And Regulated In July By Decree No. 12.551, The Economic Reciprocity Law Was Created Precisely To Allow Brazil To React In A Coordinated And Proportional Manner When Another Country Adopts Unilateral Measures That Harm Its Competitiveness.

The Rule Authorizes The Suspension Of Trade Concessions, The Limitation Of Investments, And Even The Flexibility Of Obligations Related To Intellectual Property Rights, Always In A Justified Manner And Observing Constitutional Limits.

One Of The Most Sensitive Points Is Precisely The Possibility Of Temporarily Suspending Certain Protections For Patents, Trademarks, And Other Intellectual Property Assets Of Companies From The Country That Imposed Sanctions On Brazil.

The Measure, However, Is Not Automatic: It Depends On Case-By-Case Evaluation And Can Only Be Applied With An Express Decision From The Executive.

In Addition, The Text Provides That Countermeasures May Include Calibrated Tariffs, Restrictions On Goods And Services, Or Other Specific Actions.

For This, It Is Necessary For The Camex (Chamber Of Foreign Trade) To Evaluate Whether The Foreign Measures Fall Within The Law’s Criteria And To Propose, After Public Consultations, The Specific Actions To Be Taken.

This Process Seeks To Pressure For Negotiation, While Maintaining Predictability And Avoiding Hasty Responses. The Law Functions, In Practice, As A “Reaction Manual” For The Brazilian State.

Why The Government Decided Not To Apply The Law At This Time

Even With The Possibility Of Activating This Legal Arsenal, The Planalto Chose Not To Initiate The Formal Procedure Now. According To Alckmin, The Priority Remains To Open A Direct Negotiation Channel With The U.S. Government And, Simultaneously, To Maintain The Multilateral Path Through The WTO.

The Choice Is Also Linked To The Assessment That The Tariffs Imposed By Washington Had A Strong Political Component, Associated With Internal Tensions In Brazil And The Trial Of Former President Jair Bolsonaro In The STF (Federal Supreme Court).

Sources From The Foreign Ministry State That, Although The Government Considers These Tariffs An Attempt At Interference In Brazilian Domestic Affairs, The Goal Is Still To Try To Reduce The Diplomatic Temperature Before Escalating The Conflict.

According To The Law, The Simple Opening Of The Process Would Already Send A Strong Political Signal To The U.S. That Brazil Is Ready To Retaliate. This Could Close The Doors For A Negotiated Solution, Which The Government Is Trying To Avoid At This Time.

Meanwhile, The Camex Continues To Monitor The Economic Impacts And Conducting Technical Studies On Possible Targets And Response Instruments, Should The Impasse Prolong And Dialogue Not Produce Concrete Results.

Companies Affected By Trump Tariffs Can Now Access Credit From The Brazil Soberano Plan

Brazilian Exporting Companies Impacted By The Tariff Imposed By Then-President Of The United States, Donald Trump, Can Now Request Financial Support Through The Brazil Soberano Plan.

The Announcement Was Made By The National Bank For Economic And Social Development (BNDES) On Thursday (9/18), In An Interview With The Director Of Productive Development, Innovation And Foreign Trade, José Luis Gordon, On The Program A Voz Do Brasil.

According To Gordon, Companies Will Be Classified According To The Level Of Damage Caused By The American Tariffs.

Those With 20% Or More Of Their Revenue Affected Will Receive More Favorable Conditions, Such As Reduced Interest Rates And Greater Credit Volume.

Companies With Between 5% And 20% Impact Will Have Access To Specific Lines With Differentiated Conditions, While Those With Lower Damage Will Also Be Able To Request Support, Though Under Less Subsidized Conditions.

In Total, R$ 40 Billion Will Be Made Available, Of Which R$ 30 Billion Will Come From The Export Guarantee Fund (FGE) And R$ 10 Billion From The BNDES Itself.

The Resources Have Subsidized Interest Rates And Can Be Used To Maintain Jobs, Strengthen Supplier Chains, And Direct Exports To New Markets.
