Is FGTS Ending? News Sparks Upheaval on Social Media and Leaves Workers Anxious About Possible Loss of This Right. Understand What Is Really Happening!

In recent weeks, many speculations have begun to circulate regarding a possible change in the rules of FGTS (Guarantee Fund for Length of Service), more specifically, concerning the end of the 40% penalty for cases of unjust dismissal. The news of FGTS’s demise caused a real uproar on the federal government’s social media, and many workers are concerned about the possibility of losing this guarantee. But will that really happen? Let’s understand what is behind this story.

What Does the Federal Government Say About the End of FGTS?

It all started with news outlets reporting that the federal government was studying ways to reduce expenses, and among the measures being analyzed was the 40% FGTS penalty paid by employers in cases of unjust dismissal. The idea would be part of a broader package of spending cuts, which would also include a review of other labor benefits, such as unemployment insurance.

However, these rumors were officially denied by the federal government on October 22. The Minister of Labor and Employment, Luiz Marinho, took to social media to ensure that “there is no debate about the end of the termination penalty or reduction of FGTS.” Even with this clarification, many internet users were bothered by the government’s delay in responding, given that the news had been circulating for over a week.

Why Did Rumors About the End of FGTS Gain Traction?

The possibility of changes to FGTS emerged amidst discussions about the spending cut package that the federal government is developing. The newspaper O Globo reported that, within this context, the economic team, led by Ministers Fernando Haddad (Finance) and Simone Tebet (Planning), is looking to save between R$ 30 billion and R$ 50 billion.

One of the targets of this expense reduction would be the 40% penalty paid to workers in cases of unjust dismissal, which many consider a high cost for companies and public finances.

The idea would be to redirect part of this amount to fund unemployment insurance, which saw its budget increased to R$ 52.1 billion in 2024. Although unemployment is declining, the cost of this benefit continues to rise, which puts pressure on public accounts.

Alternatives Under Discussion

Among the alternatives discussed by the federal government, one would be to transform the 40% FGTS penalty into a tax paid by companies, with a higher rate for those that dismiss more frequently. This measure would aim to discourage mass dismissals, without creating incentives for workers to seek their own dismissal, as the penalty serves as a guarantee of protection.

Another proposal would be to use part of the FGTS penalty to reduce the cost of unemployment insurance. In this way, the amount paid by the employer would still exist, but it would be partially redirected, helping to ease public finances without completely removing the workers’ right.

What Is Behind This Discussion?

The review of FGTS and other labor benefits is not a new idea. The topic has always been present in discussions on how to balance public accounts and encourage the creation of formal jobs. For many, the current model, with a 40% penalty for unjust dismissals, is seen as a fundamental protection for workers. However, for others, this penalty ends up discouraging hiring and, in some cases, encourages the search for dismissals so that the worker can withdraw from FGTS.

According to experts, the overlap of benefits, such as the termination penalty and unemployment insurance, can be seen as a factor that discourages job retention, especially during periods of labor market heating. Additionally, with the economy showing signs of recovery and unemployment decreasing, the government is seeking ways to contain mandatory spending and redirect resources to other priority areas.

Savings Generated by Ending the 40% FGTS Penalty

If the federal government decided to move forward with the idea of revising the FGTS penalty, the savings would be significant. According to the newspaper O Globo, the economic team is looking at savings between R$ 30 billion and R$ 50 billion through the revision of various labor and social policies. This would include not only FGTS but also the fight against supersalaries in the public sector and the reform of unemployment insurance.

In parallel, the government is also discussing the elimination of so-called “fringes” in public sector salaries, which allow many employees to receive above the salary cap. These measures, combined, could generate annual savings of up to R$ 4 billion.

Public Reaction and Concerns About FGTS

On social media, the reaction to the news about the end of FGTS was immediate. Many workers expressed frustration and concern about the possibility of losing this right. FGTS is viewed by many as a type of “forced savings,” providing financial protection in cases of unjust dismissal.

Many internet users criticized the federal government’s delay in officially commenting on the topic, allowing speculations to gain traction and cause more insecurity. The call for more agile and transparent communication was one of the main demands made by users on social media.

Many internet users, despite the official clarification from the government, did not believe the denial about the end of FGTS and recalled a recent episode: the controversy over the taxation of remittances below US$ 50. At that time, the government also denied the initial rumors but ended up implementing the measure shortly thereafter.

Despite all the rumors and speculations, the federal government was clear in stating that there are no plans to end the 40% FGTS penalty in cases of unjust dismissal. However, discussions about a possible review of labor and social benefits remain on the government’s radar, which seeks alternatives to reduce expenses and balance public accounts.
