Is your cell phone payment overdue? The court may authorize the blocking of your device for non-payment.

ABLE’s central argument is that regulating credit and Civil Law is an exclusive competence of the federal government — not the states. This thesis was provisionally accepted by the court, which suspended the state law until the case is definitively judged.

In upholding the injunction, the judge emphasized that the State did not present evidence of a serious risk of harm that would justify the immediate reversal of the measure favorable to businesses.

How does remote cell phone blocking for default work?

With the injunction maintained, financial institutions are authorized to remotely suspend the device’s operation — and this goes beyond merely cutting the phone signal. The blocking can also affect software and applications installed on the device.

An example cited in the process is the PayJoy system, technology used by financial institutions to remotely lock the cell phone in case of payment delay. In practice, a consumer who fails to pay one or more installments may have the device completely unusable until the debt is settled.

Who is most affected by the measure?

The impact of the decision is felt most directly by workers who depend on their cell phones to perform their professional activities — such as freelancers and app delivery drivers. This public, in general, has less access to traditional credit and resorts to installment financing to acquire a device.

On the other hand, ABLE’s president, Luciano Timm, argues that the blocking mechanism is precisely what enables access to credit for people outside the conventional banking system. In his assessment, prohibiting the practice would have the opposite effect of what is expected:

“One cannot ignore the economic impacts of such measures,” as restricting financing limits opportunities for those most in need of credit.

What consumers need to know?

  • Remote blocking of financed cell phones is authorized in Ceará while the injunction is in effect
  • The suspension can affect not only the signal, but also applications and device functions
  • The definitive judgment of the case will take place in the 5th Public Treasury Court of Fortaleza, with no date set
  • Experts advise that consumers can individually challenge blocks that show contractual irregularities
  • The state law that prohibited the practice (No. 19,547/2025) remains suspended until the outcome of the process

Ceará Court upholds decision allowing remote cell phone blocking for default. Justice rejected state law prohibiting the practice.

The Court of Justice of Ceará (TJCE) maintained the authorization for financial institutions to remotely block cell phones of consumers who delay payments for device financing. The decision was issued by Judge Washington Luís Bezerra de Araújo and rejects the state government’s attempt to reverse an existing injunction that suspends State Law No. 19,547/2025 — a norm created precisely to prohibit this type of remote locking. Until the case is definitively judged, financial institutions retain the right to block the devices of defaulters in the state.

What motivated the dispute in court?

The legal battle began when the Ceará government sanctioned, in early 2025, a state law prohibiting the remote blocking of financed cell phones in cases of default. The measure was immediately challenged by the Brazilian Association for Economic Freedom (ABLE), which filed a lawsuit questioning the validity of the norm.
