Have You Ever Imagined Being Penalized With An Astronomical Fine And The Suspension Of Your License For Overtaking? It Seems Like A Drastic Scenario, But It Is Exactly What Could Become Reality If The Latest Bill Is Approved.

This Proposal Promising To Reformulate Penalties For Dangerous Overtaking Is Causing A True Revolution In Discussions About Traffic Safety And Can Directly Affect The Way You Drive. Keep Reading To Understand All The Details Of This Proposal And How It May Impact Your Life.

The bill Under Review Defines “Dangerous Overtaking Or Irresponsible Driving” As Any Maneuver That Does Not Comply With Traffic Regulations And Puts The Safety Of Road Users, Life, Or The Physical Integrity Of People At Imminent Risk.

The Proposal Aims To Toughen Penalties For Those Who Perform Overtaking Under Adverse Conditions Or Recklessly, Increasing Fines And Penalties Associated With These Offenses.

Fine And Penalties

According To The Proposal, The Fine For The Offense Of Dangerous Overtaking Will Be R$ 2,934.70, An Amount Equivalent To Ten Times The Base Amount Of The Serious Violation Fine.

In Addition, The Infraction Will Result In 12 Months Of Suspension Of The Right To Drive And Seven Points On The Driver’s License. In Case Of Recidivism Within A Year, The Suspension Will Be Doubled, Totaling 24 Months Without Being Able To Drive.

Another Significant Measure Of The Bill Is That Drivers Penalized For Dangerous Overtaking Will Be Prohibited From Driving On Highways Or Roads For A Minimum Period Of Two Years From The Date Of The Infraction.

This Proposal Reflects The Growing Concern For Safety On The Roads And The Need For More Severe Penalties To Curb Behaviors That Put Lives At Risk.

Recent Data On Fines

In 2023, Brazil Recorded Approximately 2 Million Infractions Related To Dangerous Overtaking, According To Data From The National Traffic Department (DENATRAN). In 2024, By July, This Number Has Already Reached About 1.1 Million.

Impact Of The New Rules

The Implementation Of The Proposed New Rules May Have A Significant Impact On The Way Drivers Approach Driving And Overtaking.

Studies Indicate That Higher Fines And Longer Suspensions Have A Direct Effect On Reducing Risky Behaviors.

For Example, Data From The World Health Organization (WHO) Shows That Countries With Stricter Traffic Policies Tend To Have Lower Accident And Traffic Fatality Rates.

Moreover, The Proposal May Influence The Way Traffic Authorities Conduct Enforcement. With Harsher Fines And Penalties, There Is An Expectation For Increased Oversight And Enforcement Of Traffic Laws, Contributing To A Safer Environment For All Road Users.

Next Steps

Currently, The Bill Is Undergoing A Conclusive Analysis Process By The Committees Of Transportation And Traffic, And Of Constitution, Justice, And Citizenship. To Become Effective Law, The Proposal Still Needs To Be Approved By The Chamber Of Deputies And The Senate.

The Progress Of The Proposal Will Be Closely Monitored By Road Safety Experts And Society, Who Expect A More Effective Response To The Daily Traffic Problems Faced.
