Severe Conditions Exempt From Waiting Period And Allow Immediate Benefit, As Long As The Insured Proves Permanent Disability
Workers diagnosed with certain severe diseases may have the right to disability retirement without fulfilling the waiting period. The new INSS list, valid for August 2025, includes 15 diseases that guarantee immediate retirement, provided that permanent inability to work is proven.
This measure aims to expedite access to benefits in cases of severe and irreversible illnesses. Even without the minimum number of monthly contributions required in common situations, the insured can receive the full amount if they are up to date with the INSS or within the so-called “grace period.”
What Is Disability Retirement?
Disability retirement is a social security benefit aimed at workers permanently unable to perform their professional duties due to illnesses or accidents. To obtain this right, the insured must undergo medical examination by the INSS that proves their condition.

In general, a waiting period of 12 monthly contributions is required, but this requirement is waived in cases of severe diseases, as stipulated by law and officially recognized by the National Institute of Social Security.
Which Diseases Guarantee Retirement Without Waiting Period?
According to the Jusbrasil portal and current INSS rules, these are the 15 diseases that exempt the worker from the waiting period to receive disability retirement:
- Parkinson’s Disease
- Active Tuberculosis
- Mental Alienation
- Blindness
- Severe Nephropathy
- AIDS (Acquired Immunodeficiency Syndrome)
- Multiple Sclerosis
- Leprosy
- Severe Hepatopathy
- Ankylosing Spondylitis
- Severe Osteitis (Paget’s Disease)
- Irreversible and Disabling Paralysis
- Malignant Neoplasm (Severe Cancer)
- Severe Cardiopathy
- Radiation Contamination (with specialized report)
These diseases are classified as high risk and profoundly compromise the patient’s ability to perform basic and professional activities.
Who Can Apply for the Benefit?
Even though the waiting period is waived, having a diagnosis is not enough. The insured must be contributing to the INSS or within the grace period, meaning the timeframe during which the worker retains their rights even without actively contributing.
Additionally, it is mandatory to prove permanent incapacity at the time of application through a medical examination. This assessment is conducted by medical examiners from the INSS itself.
How to Apply for Disability Retirement?
The application can be made through the following channels:
- Meu INSS Website or App
- Phone 135 (Customer Service Center)
- INSS Physical Agencies, with prior scheduling
During the examination, the doctor will evaluate the disease report, complementary tests, and professional history to confirm total and definitive incapacity for work.
If approved, the retirement is granted without the need to fulfill the minimum waiting period, as long as the worker is within the legal conditions.

Olá bom dia!!! Isso é bom pra quem realmente sofre com alguma incapacidade. Eu msm não tenho os movimentos do meu braço direito acho que tenho uns 40 % os movimentos dele e aqui onde eu moro vejo muitas pessoas fazendo esquema pra se aposentar acho isso uma tremenda safadeza! Eu só não corro atrás pq sou autônomo e não contribuinte mas isso que estão fazendo será bom
