A father from Anápolis (GO) reported that his son was baptized by a local church without his authorization and using his personal data. The incident occurred in late 2024 and raised questions about possible violations of the Code of Canon Law and the General Data Protection Law (LGPD). The information comes from the Metrópoles portal.

According to lawyer Mariane Stival, who represents the man, the case may reach the Vatican as a last resort if local instances do not provide a solution.

The Confirmation of the Baptism

According to the lawyer, the situation came to light on Christmas 2024. When picking up his son to spend the afternoon together, the father repeatedly heard the child mention the “godmother” and “godfather,” who are his maternal uncles.

Suspicious, he contacted the Diocesan Curia of Anápolis to confirm the information. There, he was informed that the boy had been baptized on August 4, 2024.

The baptism certificate presented the father’s name as if he had signed the request, although he was completely unaware of the ceremony.

According to Mariane, several notifications were sent to the responsible parish and to the Diocesan Curia itself.

As there was no satisfactory response, the case was taken to the Public Ministry and to the National Data Protection Authority (ANPD), which also attempted to contact the Curia, without success.

Therefore, the next step may be the Ecclesiastical Tribunal, which would have the authority to rectify the documents and ascertain responsibilities.

Moreover, if there is a negative response from local instances, there is the possibility of appealing directly to the Holy See.

What Canon Law Says About Baptism

Canon Law provides clear rules for the celebration of baptism. Among them is the requirement for consent from at least one of the parents or from someone with legitimacy to represent them.

Another condition is the expectation that the child will be educated in the Catholic faith. If there is no such guarantee, the baptism should be postponed.

Additionally, the responsible pastor needs to carefully record the names of the baptized, the parents, godparents, witnesses, and also indicate the date and place of birth.

Raised Questions

The lawyer clarifies that the complaint is not a rejection of religion or the Catholic Church. The central point, according to her, is the violation of parental authority.

The decision regarding the education and religious upbringing of the child is a matter that must be jointly exercised by the parents, and cannot be practiced unilaterally,” emphasized Mariane.

For her, baptism is a social and cultural milestone, and the exclusion of one of the parents represents a direct affront to parental authority.

Moreover, she stressed that there was misuse of the father’s personal data in the request. This conduct violates the LGPD, which requires a legal basis and transparency for the processing of information.

Church Response

Metrópoles sought contact with the Diocese of Anápolis but did not receive a response by the time the article was published. The space remains open for a statement.
