TCM Decision Halts Bids of the Municipality Evaluated at Over R$ 707 Million
The Municipal Court of Accounts of Rio de Janeiro (TCM-RJ) suspended, on September 16 and 18, 2025, two electronic auctions of the Department of Conservation of the Municipality. These bids were part of the Smooth Pavement program, planned for milling, resurfacing, and signaling in various regions of the city. The total value of the bids reached R$ 707.5 million.
Technical Analysis Indicates Inconsistencies in the Bids
The counselor David Carlos, the rapporteur of the process, highlighted that the technical analysis identified inconsistencies capable of generating an impact of R$ 8.25 million, equivalent to 2.12% of the auction for the Planning Areas 1 and 2 (Central, South Zone, and Grande Tijuca), estimated at R$ 388.9 million.
Additionally, the assessment related to the Planning Area 3 (North Zone) estimated an impact of R$ 7.85 million, equivalent to 2.47% of the total value. In light of this, the counselor determined the suspension of the auction on September 18, 2025.

Monocratic Decision and Tribunal Directions
The suspensions occurred by monocratic decision and remain in effect until the merit is judged by the plenary. Furthermore, the counselor determined that the 2nd General Inspectorate of External Control expand the investigations, to complement the analysis of the notices.
Therefore, while the judgment does not occur, the bids remain blocked, which interrupts the schedule planned for the Smooth Pavement program.
Department of Conservation Denies Irregularities
The Secretary of Conservation and Public Services, Diego Vaz, stated that the notices do not present irregularities. According to him, the Tribunal’s questions are specific and preventive, common in the monitoring of bidding processes.
In an official statement, Vaz declared: “The Conservation reiterates its commitment to full cooperation with the TCM so that the process occurs without any nullity”. Additionally, he explained that the points raised have already received responses from the department.
Continuous Dialogue with the TCM
The Department emphasized that previous meetings with the TCM have already occurred and that a new meeting is scheduled for September 22, 2025. Thus, according to the agency, the objective is to ensure transparency and care in the use of public resources.
As such, the procedures continue under joint analysis until the Tribunal deliberates on the legality of the bids.
Impact of the Suspension on the Smooth Pavement Program
The Smooth Pavement program is considered essential for the roadway infrastructure of the capital. However, the temporary suspension of the bids halts the selection of companies that would carry out the services on the streets and avenues of Rio.
Consequently, the execution of the works will depend on the Tribunal’s final decision, which still does not have a defined timeline for judgment.
