The Court’s Decision Prohibits the Operation of the Service, Generating Controversies Between the City Hall and the Transport Platforms

The Uber and 99 transport platforms suspended, on the last Monday (May 26), the mototaxi service in the city of São Paulo, according to the Infomoney website. The decision was made in response to a new order from the State Court of Justice (TJ-SP), which prohibits the modality and imposes a daily fine of R$ 30 thousand on each company in case of noncompliance with the determination. This measure arises in a context of growing concern over road safety, especially after a fatal accident that occurred on Avenida Tiradentes, resulting in the death of a passenger.

The Context of the Prohibition

The prohibition of mototaxi reignites a clash between the City Hall of São Paulo and the transport platforms. Since 2023, the administration of Mayor Ricardo Nunes (MDB) has been trying to prohibit the mototaxi service, arguing that the measure aims to protect the safety of users. The mentioned accident, which occurred during a mototaxi ride, served as a catalyst for the legal action that led to the suspension of the service. Have you ever stopped to think about the risks involved in using a motorcycle transport service?

The decision of the judge Eduardo Gouvêa, from the 7th Chamber of Public Law, represents another chapter in a dispute that has intensified over the course of this month. On May 14, Judge Josué Vilela Pimentel had allowed the operation of app-based mototaxis, but two days later, Gouvêa suspended this injunction and recommended that the City Hall prepare specific regulations within 90 days. The 99 continued its operations by filing an appeal, while Uber decided to suspend the service preventively.

The Position of the City Hall and the Allegations of the Platforms Uber and 99

In the new decision, TJ-SP reaffirmed that the regulation of private individual transport is the exclusive competence of municipalities, as provided in Article 11-A of the National Urban Mobility Policy. This prerogative is defended by the City Hall, which believes that the 2023 decree prohibiting the service is backed by the need to ensure passenger safety. But does this decision really meet the needs of users who depend on this type of transport?

99, which reports having conducted over 1 million rides by motorcycle in the city of São Paulo, argues that the decree is unconstitutional and that regulation should be done through a law passed by the City Council. On the other hand, Uber highlights that it has accumulated more than 20 favorable decisions regarding the legality of mototaxis in other cities in Brazil, which raises questions about the uniformity of rules for the service throughout the country.

The Impact on Urban Mobility

The suspension of the mototaxi service can have a significant impact on urban mobility in São Paulo. With traffic already congested and the need for agile transport options, many users who rely on this service will feel affected. The city, which constantly faces challenges regarding public transport, will see an increase in demand for alternatives, such as taxis and ride-sharing, but these options may not be sufficient to meet everyone’s needs.

Have you ever used the mototaxi service? How do you evaluate the safety and efficiency of this type of transport compared to other available options? It’s important for people to share their experiences and opinions on the issue, as this can help shape future decisions regarding regulations and safety in transportation.

The Search for Solutions from Uber and 99

Given the current scenario, it is crucial that the City Hall of São Paulo seeks solutions that ensure user safety without compromising the availability of transport services. The regulation of mototaxi could be an opportunity to establish rules that protect both passengers and drivers, promoting a safer environment for all.

Meanwhile, the transport platforms will have to adapt to this new reality, seeking ways to operate within legality and meeting users’ demands. The lingering question is: how can companies innovate and adjust to ensure the continuity of their services in a safe and legal manner?
