New Labor Law Guarantees 180 Days at Home Without Losing Money
The new labor law, which comes into effect in 2024, promises to bring a significant change for millions of Brazilian workers governed by the CLT. The main novelty? Maternity leave will be extended to 180 days, ensuring that mothers can spend more time with their newborns without losing a single cent of their salary.
New Labor Law
With this new labor law, the maternity leave period will increase from 120 to 180 days. This means that, in addition to being able to spend more time caring for their babies, mothers will not have any reduction in their monthly earnings. This measure is a relief for many families, who will be able to focus on the initial care of their children with more peace of mind.
According to the Pontotel portal, the new law also offers flexible options for mothers to choose the best leave format. In addition to the 180 days with full salary, workers can opt for 120 days with full salary, followed by 60 days receiving half of the salary. Another alternative is to split the period: 60 days with full salary and 120 days with a 50% reduction in the amount.

Special Cases and Adoption
This new labor law also takes special situations into account. Premature births, births of children with disabilities, or adoption of children under one year old are also expected to extend the leave. For adoptive mothers, the rule changes according to the child’s age. Children aged one to four years guarantee 30 extra days of leave, and those aged four to eight years, an additional 15 days.
Another novelty is that collective agreements can further extend the leave period, providing even greater protection for mothers in the labor market.
Impact on Different Categories of CLT Workers
The new labor law also extends its benefits to different categories of workers, including individual micro-entrepreneurs (MEIs), freelancers, and domestic workers, all governed by the CLT. In the case of MEIs and freelancers, the leave amount will be calculated based on the average of the last 12 months of contributions to the INSS. For domestic workers, the benefit will be equivalent to the last salary.
For special insured individuals, such as rural workers, the payment will be a minimum wage, ensuring that all categories of mothers are covered.
Expansion of Paternity Leave
Not only mothers benefited from the new labor law. In 2023, fathers also had their paternity leave extended from 5 to 20 days. Now, fathers can choose to take the 20 days all at once with full salary or split the period, taking 10 days with full salary and another 10 days at half the amount.
This measure is seen as a step forward in promoting equality in the family environment, recognizing the role of fathers in caring for their children and offering more time for them to actively participate in the routine with the baby in the first days of life.
