Deputies Approve Bill That Ensures Consumers the Chance to Inspect the Product at the Time of Purchase and Secure Quick Solutions.

The Consumer Defense Commission of the Chamber of Deputies has approved a bill that ensures consumers the right to inspect the product at the time of purchase.

The proposal was presented by Deputy Ricardo Ayres (Republicanos-TO) and received amendments from the rapporteur, Deputy Aureo Ribeiro (Solidariedade-RJ).

The approved text guarantees that, upon identifying irregularities, the consumer can immediately exercise the rights provided in the Consumer Defense Code.

Guaranteed Rights

Among the options provided are the replacement of the item with another of the same kind in perfect condition, the refund of the amount paid, or a proportional discount on the price.

These measures allow the customer to resolve issues without bureaucracy, as the procedure can be carried out directly at the point of sale.

Changes Made

The rapporteur removed from the proposal sealed products, pre-packaged foods, and goods delivered to the consumer’s home. According to Aureo Ribeiro, the exclusion prevents risks of violation in frequently used items.

Various products, such as soaps, toothpaste, fabric softeners, shampoos, deodorants, cleaners, and other widely sold items, for example, would become vulnerable to violation at the point of sale,” he explained.

Moreover, he emphasized that the change maintains sanitary safety and consumer confidence in these daily-use items.

Next Steps

The proposal is progressing in a conclusive manner. This means it will be analyzed directly by the Chamber’s committees, without the need for a floor vote, unless there is an appeal.

Now, the text goes to the Constitution and Justice and Citizenship Commission.

If approved, the matter will still go through the Senate before becoming law.
