The Legal Fuel Institute (ICL), with its president Emerson Kapaz and director Carlo Faccio at the helm, is present at Expocom 2023 to highlight the importance of the swift approval of PLP 164 / 2022. The proposal, which aims to consolidate federal legislation against the chronic debtor, is a hot topic in the discussions at the fuel reseller fair in the states of Paraná, Santa Catarina, and Rio Grande do Sul.
The Future of the Brazilian Market
Today, starting at 2:30 PM, Kapaz will illustrate the outlook for the “Future of the Fuel Market in Brazil”. Following this, at 3:30 PM, Faccio will discuss the “Combatting the Irregular Market in the Fuel Sector”. Both discussions revolve around the significance of PLP 164 / 2022, a tool that will allow states to implement Special Taxation and Inspection Regimes. The implementation aims to curb the actions of companies and entrepreneurs that deliberately harm both public finances and the final consumer.
The situation is alarming: the fuel sector has seen a loss of over R$100 billion due to tax evasion and delinquency recently. Kapaz highlights that “R$14 billion is linked to accounting fraud and tax delinquency, such as ‘shell’ companies to conceal tax evasion”. This amount could have been redirected to benefits for society, such as investments in education, health, and security.

Despite 15 states and the Federal District already having legislation aimed at defining the chronic debtor, the national scenario lacks uniformity. Carlo Faccio emphasizes the urgency of a “federal law to standardize the obligations and penalties across the country.”
In the intricate fiscal landscape, ill-intentioned individuals exploit loopholes for illegal activities, such as money laundering and operations related to organized crime. Kapaz reinforces that “tax evaders gain unfair competitive advantages in the fuel sector.”
For the ICL, fair competition should be the guiding principle for all economic segments. Faccio concludes, pointing to a market increasingly threatened by sophisticated illegalities and unfair competition practices, which inhibit investments and compromise the state’s revenue capacity.
