Proposal Aims to Change Rules for New Drivers on Highways, Establishing a Specific Safe Driving Course and Restricting Access to Roads Until Completion of the New Stage. The Text is Under Conclusive Review in the Chamber of Deputies.

New drivers may be prevented from driving on highways until they complete a specific safe driving course, if the PL 2337/2025 progresses in Congress and becomes mandatory for the full use of the National Driver’s License (CNH).

The proposal, presented by deputy Julio Arcoverde (PP-PI), amends the Brazilian Traffic Code (CTB) to condition access to highways and roads, during the Learning Permit (PPD), to obtaining a certificate regulated by the National Traffic Council (Contran).

The project aiming to add the norm for the full use of the CNH was filed in May this year and is currently awaiting the rapporteur’s opinion in the Committee on Transportation and Transit (CVT), in conclusive proceedings. If approved in the committees and there are no appeals to the Plenary, it will proceed to the Senate.

What Changes for Those with a PPD

The text creates Article 159-A in the CTB, stating that the permit holder may only drive on highways and roads after successfully completing the safe driving course.

Until then, driving will be restricted to urban areas. The provision also refers any noncompliance to the penalties in Article 162, Item VII of the CTB.

In practice, the measure does not change the validity of the PPD or the criteria for obtaining the permanent CNH after one year without serious, very serious infractions, or average recidivism.

The proposed change to the CNH regulations only affects driving on highway roads during the initial driving period.

Course Content and Certification Registration

The regulation would be the responsibility of Contran, which would define workload, syllabus, methodology, and possibilities for distance learning.

The project allows the completion of the course to be recorded in the driver’s record, a solution that enables electronic monitoring without the creation of a new physical document.

The regulation must align with Contran Resolution No. 789/2020, which is currently a reference for training and updating courses in the National Traffic System.

It will be up to Contran to harmonize calendars and requirements if the PL is approved and sanctioned.

Penalties Provided in the CTB

By referring to Article 162, VII, the project stipulates that driving without the mandatory course incurs the already existing infraction for “driving a vehicle without the required specialized or specific courses”, which is classified as very serious and carries a fine, in addition to vehicle retention until a qualified driver is presented.

Today, this classification is used, for example, in courses required for the transportation of schoolchildren, passengers, or hazardous materials.

Process and Progress in the Chamber

PL 2337/2025 has been distributed to the committees of Transportation and Transit and Constitution, Justice and Citizenship (CCJC), with conclusive review.

In the CVT, deputy Paulo Litro (PSD-PR) was appointed rapporteur on August 21, 2025.

The five-session deadline for presenting amendments began on August 25 and ended on September 4, 2025, with no amendments submitted, keeping the original text under discussion.

While it is being processed, there is no regulation from Contran for the proposed course, nor a timeline for implementation. Any regulatory act will only come if the change in the law is approved and sanctioned.

Impact on Candidates and New Drivers

If it becomes law, the measure will require additional planning for those obtaining their first license or who have just passed the practical exam.

The permit holder would remain able to drive in urban areas, respecting the other rules of the CTB, but would be prohibited from accessing highways until completing the new training with satisfactory performance.

Depending on the regulation, the course may include theoretical, practical, and distance learning modules, as well as learning assessments.

Driving schools and Driver Training Centers would need to adapt content and methodology to the standard that will be defined, and Detrans would need to adjust registration and consultation systems to allow for electronic verification of the certificate by regulatory agencies.

These points will be detailed by Contran if the proposal moves forward.

Technical Foundation and Justification

The author’s justification argues that driving on highways involves risks distinct from urban driving, with higher operational speeds, longer braking distances, presence of heavy vehicles, and overtaking protocols and access to acceleration and deceleration lanes.

It also cites factors such as monotony of long stretches and weather conditions that impact safety.

By conditioning highway traffic on the completion of a specific training, the project aims to achieve reduction of accidents among inexperienced drivers and aligns the requirement with the logic of specialized courses already provided for in legislation.

What to Watch Going Forward

As the evaluation is conclusive, the text regarding the change in CNH regulations may be approved in the committees and sent directly to the Senate, unless there is a request for a plenary vote in the Chamber.

In case of adjustments, the committees may define minimum workload, evaluation criteria, and transition phases for implementation.

For now, for those in the process of obtaining their license, the situation is one of monitoring official proceedings and adhering to the current rules of the CTB.

For those planning to hit the road in the first year of driving, would a mandatory safe driving course on highways provide enough preparation to reduce risks, or would it become just another cost and time barrier before being allowed to travel?
