New Law Allocates Fine Money to Pay for Driver’s Licenses for Low-Income Drivers

New Rule Changes The Traffic Code And Allows Fines To Fund The Licensing Of Low-Income People. The Rule Also Digitizes Vehicle Transfer And Brings Changes Vetoed By The Federal Government.

The new Law 15.153, sanctioned by President Luiz Inácio Lula da Silva on June 26, 2025 and published in the Official Gazette of the Union on June 27, amends the Brazilian Traffic Code (CTB) to allow the use of resources from traffic fines to fund the licensing of low-income drivers.

The rule expands the already established purposes, such as inspection, signaling, and education, and includes the “social CNH”, aimed at individuals registered in the Cadastro Único for Federal Government Social Programs (CadÚnico).

From now on, the amounts collected from infractions will be able to finance all stages of driver training: the fees charged by State Traffic Departments (Detrans), practical and theoretical classes, exams, and document issuance.

The benefit is restricted to individuals registered in the CadÚnico, a condition that defines “low income” for the purposes of the program.

How The Social CNH Works

The approved text establishes that the funding of the social CNH will involve all stages of the process, without restrictions.

This includes:

  • Administrative fees.
  • Classes and training (theoretical and practical).
  • Medical and psychological exams.
  • Issuance of the CNH.

This measure aims to provide access opportunities to the job market, especially in occupations that require driving, such as delivery drivers, app drivers, or transport of small loads.

Electronic Transfer Of Vehicles

The law also modernizes the transfer of vehicle ownership.

From now on:

  • The entire operation can be done electronically, by the traffic authority.
  • The sales contract must contain qualified or advanced electronic signatures, according to Law 14.063/2020.
  • Electronic contracts will have validity throughout the national territory.
  • The vehicle inspection for transfer may be conducted electronically, according to criteria established by each state or the Federal District.

These innovations seek to streamline administrative processes, reduce bureaucracy and operational costs for users and the public authorities.

President’s Vetoes

The president vetoed five provisions of the original text, approved by Congress:

Use of private platforms for electronic signatures, due to concerns that this would fragment the infrastructure and create legal insecurity.

Mandatory toxicological exam for the first CNH in categories A and B, in addition to allowing medical clinics conducting the physical and mental fitness exam to carry out toxicological tests — both vetoed due to potential cost increase and risk to the integrity of the exams.

Immediate effectiveness of the law, which has been postponed to 45 days after publication, as required by the Law of Introduction to Brazilian Legal Norms.

So far, there are no defined dates for the consideration of the vetoes in Congress, which may choose to uphold or reverse them.

No updated information has been found about deadlines for this analysis.

Origin And Amendments To The Traffic Code

The Law 15.153 originated from PL 3965/2021, authored by Deputy José Guimarães (PT‑CE), proposed on November 9, 2021.

The project was approved by the Chamber in May 2023, highlighting the inclusion of the toxicological exam by a rapporteur, but later adjusted in the Senate by Randolfe Rodrigues (PT‑AP) and Dr. Hiran (PP‑PR) in the Constitution and Justice and Human Rights committees.

After the sanction, the standard text of the CTB was amended as follows:

  • Art. 320, caput: resources from fines may be used for the licensing of low-income people.
  • § 4º: details that the funding includes fees, training, and issuance of the CNH.
  • § 5º: defines CadÚnico as the eligibility criterion.
  • Art. 123, § 4º: allows the transfer and inspection of vehicles by electronic means.

Expected Impacts With The New CNH Law

Experts and parliamentarians point out that the initiative can reduce economic barriers for those seeking licensing, especially young people from vulnerable areas.

The justification states that the high cost of the CNH makes it unfeasible for these citizens to enter jobs that require driving, making the new mechanism an alternative without tax increases.

The adoption of digital signatures and inspections promises to simplify the transfer process, with a direct impact on the reduction of bureaucracy, waiting time, and costs of traveling to physical offices.

Deadline For The Law To Come Into Force

The law provides that its rules come into effect 45 days after publication, which sets the effective date for August 11, 2025.

This deadline allows traffic authorities to adapt to the new guidelines and necessary infrastructure.

What Has Not Yet Been Defined About The CNH Funded By Fines

Currently, there is no official information regarding:

  • Operational criteria defined by the Detrans for selecting and managing the social CNH.
  • Forecast budget and estimate of how many citizens will benefit.
  • When and if Congress will analyze the vetoes.
  • This data will be important to understand the feasibility and scope of the policy in the coming months.

Will this law be able to create a significant impact on social mobility and the job market for low-income Brazilians, or will the practical effects depend on factors that still need to be defined by the responsible authorities?
