New Legislation in Rio de Janeiro Prohibits the Sale of Used Thermal Bags by Delivery Drivers, Requiring Individual Identification and Supply Only by Official Platforms to Increase Security and Control in the Sector.

Starting in July 2025, drivers and delivery workers using apps like iFood in Rio de Janeiro will face new regulations: the sale and commercialization of used ‘bags,’ the traditional thermal bags used for transporting food, is prohibited.

Only the delivery platforms themselves will be able to supply the item to professionals, who must use properly identified bags, with thermal insulation and reinforced sealing.

The measure was officially announced after being sanctioned by Governor Cláudio Castro this Wednesday (16).

The decision was motivated by an unusual factor: the growing misuse of these bags by individuals impersonating delivery drivers to commit crimes, such as robberies and thefts in residences.

According to state authorities, the new legislation aims to make it more difficult for criminals to access the accessory, making it mandatory to link the identification number of the bag to the delivery driver registered on the platform.

This way, it is intended to ensure more security for those using delivery services and for the professionals in the sector.

Security in the Use of Delivery Thermal Bags

The enactment of the law brings significant changes to the daily lives of delivery drivers working with delivery apps.

From now on, every thermal bag used must be supplied exclusively by the intermediary company providing the service, such as iFood, Rappi, Uber Eats, or similar platforms.

According to the approved text, each bag will receive a unique number, directly associated with the registered delivery driver, which will facilitate identification in cases of irregularities.

Additionally, the regulation sets technical specifications for the equipment, such as effective thermal insulation, adequate sealing for food transport, and mandatory hygiene conditions.

The goal is to ensure the quality and safety of both the transported products and the services provided.

Reasons for Prohibiting the Sale of Used Bags

The prohibition on the sale and reuse of used thermal bags is supported by increasing reports of crimes committed by individuals who, without any link to the platforms, were buying or acquiring second-hand bags to simulate being a delivery driver.

Security camera images captured recent cases in neighborhoods in the North Zone of Rio de Janeiro, such as Bento Ribeiro, where individuals used thermal bags to enter residences and commit thefts.

According to Governor Cláudio Castro, the restriction represents a way to value the work of registered delivery drivers while limiting the actions of fraudulent professionals.

We cannot allow criminals to take advantage of an essential service to commit crimes. Now the sector will have more control and transparency, also giving more trust and dignity to those who work honestly and to those who use this type of service“, Castro said during the announcement of the law.

Impacts on Delivery Drivers and Delivery Apps

For delivery drivers, the new law requires immediate adaptation to the mandatory use of the bag supplied by the company, which may involve additional costs or procedures, depending on the policy of each platform.

There are reports of professionals concerned about potential delays in receiving the new bags or difficulties replacing the item in case of damage or loss.

On the other hand, representatives of apps emphasize their commitment to ensuring greater security for clients and employees, stating that operational adjustments are already underway to comply with the legislation.

Organizations linked to the category of delivery drivers are monitoring the implementation of the rules and demanding that there be no transfer of costs to self-employed professionals.

For many workers, the main concern is the need for quick and streamlined access to thermal bags, especially given the increasing unemployment and the growth of delivery platforms as a primary source of income in the state of Rio de Janeiro.

Mandatory Identification of Delivery Thermal Bags

With the law in effect, each thermal bag will be personalized with a unique identification number directly linked to the delivery driver’s registration in the delivery platform’s system.

This will allow regulatory authorities, in potential inspections, to verify if the professional using the bag is indeed the one authorized by the app.

In addition to inhibiting fraud and crime, the measure creates a traceability mechanism for food transport, contributing to higher standards of hygiene, safety, and responsibility in delivery services.

According to the government of Rio de Janeiro, any irregularities detected during inspections may result in warnings, fines, or even the exclusion of the professional from the platform.

Changes for Consumers and the Delivery Sector

From the consumers’ perspective, the main change will be an increase in confidence in the delivery service, given the assurance that only registered professionals will be using the regulated bags.

Public safety experts assess that the measure could help reduce instances of scams and thefts in residences, although they emphasize that effective oversight will be crucial for the success of the new legislation.

For the delivery sector, the new rules require investments in logistics, tracking technology, and standardization of equipment.

Companies will need to implement stricter controls on supplying thermal bags and keep updated records of all authorized professionals.

Prohibition of the Sale of Delivery Thermal Bags Is Already in Effect

Since the law was published, the sale, commercialization, or transfer of used thermal bags is strictly prohibited throughout the state of Rio de Janeiro.

Failure to comply with the rules may result in penalties for both sellers and buyers of the item outside the established conditions.

The legislation adds to a set of state and municipal measures implemented in recent years aimed at regulating and overseeing the work of delivery app drivers.

The government’s expectation is that the new measure will help increase user trust and strengthen the delivery sector as a safe source of income for thousands of workers.
