Regulatory agency's measure allows the plant's operations to resume based on technical and legal criteria, without promising extraordinary economic effects
The National Agency of Petroleum, Natural Gas and Biofuels (ANP), published the formal authorization in the Official Gazette of the Union on May 6, 2025. Although Baldin Bioenergia has been under judicial recovery since June 2022, the ANP granted the approval based on technical and regulatory documentation. As established by ANP resolution no. 734/2018, the company can resume its operations, as long as it meets the specific conditions required by law. For this reason, the decision does not represent a privilege, but rather compliance with valid technical, legal and operational requirements. Thus, Baldin will be able to operate regularly, being duly monitored, without exceeding the established regulatory limits.
The plant has the installed capacity to produce 460 thousand liters per day
Baldin Bioenergia implemented its unit at km 209 of the Anhanguera Highway, in Pirassununga, in 2010, two years after its foundation, in 2008. The plant has technical production capacity of up to 460 thousand liters of hydrated ethanol per day, as reported to the company itself ANP in the authorization process. The operational resumption, therefore, follows regulatory standards, aiming to contribute to the supply of ethanol gradually and in accordance with market demand. Resumption of operations follows recovery plan presented to the Court
Em December 2023, Baldin filed a restructuring plan providing for partial return of production in 2025, subject to obtaining licenses and regularizations. With the ANP authorization now effective, the company will be able to follow the schedule approved in court, which includes gradual reactivation of activities and maintenance of local jobs. The specialized press and the judiciary received the data, which indicates that around 200 jobs will be gradually resumed.

Measure prevents shutdown of already installed production structure
The ANP considered that the active plant maintenance, even in legal proceedings, would contribute to avoid wasting infrastructure that has already been built and technically approved. In addition, the inspection and operational control process remains in force, in accordance with the guidelines of safety, environmental impact and technical regularity, with continuous monitoring by the agency. Petrobras did not disclose extraordinary production targets or projections of accelerated expansion, which preserves the technical and cautious nature of the decision.
Ethanol continues to be a strategic asset in the national energy matrix
The Brazilian government regulates ethanol production through public policies such as RenovaBio, in force since 2020, and the National Energy Plan 2050, coordinated by the Energy Research Company (EPE). The Ministry of Mines and Energy considers ethanol to be strategic for driving the energy transition and meeting national climate goals, including those under the Paris Agreement. Therefore, by allowing plants with a functional structure and regular status to continue operating, the authorities maintain the stability of the sector without compromising the competitive balance of the market.

Should the company fail to comply with environmental, technical or financial standards, the agency may review the authorization. The agency emphasized that it analyzed the case individually, without creating precedents for indiscriminate concessions to other companies in difficulty. Finally, the episode highlights that stable and transparent regulatory policies are essential to preserve economic activity within legal limits.
