The Transportation Commission approved Bill 3308/24, which revokes Law 7,290/84 because Law 11,442/07 already establishes a broader framework for road transportation, redefining criteria for independent carriers and reducing legal risks.

Reporter Zé Trovão stated that the 1984 regulation is incompatible with the current reality and causes distortions that can create legal and economic risks, emphasizing that its maintenance jeopardizes sector operations and requires immediate regulatory updates.

Author Toninho Wandscheer explained that revocation is justified because Law 11,442/07 offers a more comprehensive definition by including owner, co-owner, or lessee of at least one vehicle, avoiding inaccuracies that could lead to litigation over contracts.

He added that Law 7,290/84 restricts independent carriers to the owner of a single vehicle, creating interpretative gaps that are considered inadequate and capable of increasing operational costs, which reinforces the need to modernize the legal framework.

Next Steps in the Process

The bill proceeds in a conclusive manner for analysis in the Labor and Constitution, Justice, and Citizenship committees, and must be approved by the Chamber and the Senate before becoming law, as stated by the Agency Câmara de Notícias in its note.
