99Moto Returns to São Paulo After Court Decision to Overturn Decree. In Just 13 Days of Operation, Transportation App Generated R$ 7 Million to Local Economy.
The dispute between the São Paulo City Hall, 99Moto, and Uber has gained another chapter in the courts. The victory now belongs to the transportation app, and 99Moto returns to São Paulo, as the decree that prohibited the mototaxi service in the city was overturned by Judge Josué Vilela Pimentel from the 8th Public Finance Court.
Understand Why the Court Determined the Victory of the Transportation App
According to the court, the City Hall does not have the authority to veto the provision of a service authorized by a federal law; it can only regulate it by establishing guidelines for its execution. Thus, 99Moto returns to São Paulo and is already planning to resume service, while Uber remains cautious, stating that it advocates for regulation to ensure the safety of users and drivers.
To better understand, the decree from São Paulo was issued because the City Hall considers that mototaxi transportation is dangerous due to the complex traffic conditions in the city. A decree published in 2023 prohibited the app service in Brazil’s largest city; however, 99Moto and Uber resumed service in the municipality based on Law No. 13,640, which allows for app-based transport to operate in the country, whether by car or motorcycle.

The transportation app defended itself against the decree from Ricardo Nunes, the mayor of São Paulo, claiming that motorcycle transportation would be dangerous for passengers and mototaxistas. The company stated that during the 13 days of operation from January 14 to 27, 500,000 trips were made with only two minor accidents, with 15,000 motorcyclists generating over R$ 7 million and boosting the municipality’s economy.
City Hall Will Appeal the Decision of TJ-SP About the Decree
In a statement to Folha de S.Paulo, the São Paulo City Hall informed that it will appeal the TJ-SP decision. According to 99Moto’s communications director, Bruno Rossini, the company continues to fight for the right of users and motorcyclists who demand the return of the transportation app, in addition to collaborating for regulations that bring mobility and safety for all.
According to Uber, the decision allowing 99Moto to return to São Paulo reinforces Uber’s understanding of the legality of Uber Moto in the capital. Instead of prohibiting, the ideal would be to develop proper regulations, optimizing safety and organization for everyone.
The company claims it remains open to dialogue to define rules before resuming service. In contrast, the Attorney General’s Office of São Paulo states that it will appeal and asserts that the city is not prepared for this type of service.
365 Motorcyclists Lost Their Lives in Accidents in SP
The Attorney General’s Office also highlights that there is another ongoing legal action that prohibits the mototaxi service in SP, with Mayor Ricardo Nunes stating that the transportation app service is a carnage, as 364 motorcyclists died in accidents in the last year in the city.
Between the previously mentioned dates, the ten neighborhoods that used the service the most were Capão Redondo, Jabaquara, Tucuruvi, Tatuapé, Itaim Paulista, Santana, Vila Sônia, Santo Amaro, and Grajaú. While it was operational, around 170,000 users utilized 99Moto in the capital.
It is worth remembering that the service was temporarily suspended in the capital following a decree from the São Paulo Court of Justice. 99Moto appealed the decision based on understandings from the Federal Supreme Court (STF) and over 20 judicial decisions across Brazil indicating that city halls cannot impede such activity.
