Importance of Competition in the Fuel Market
Brazil, with its vast network of over 43,000 gas stations and more than 140 fuel distributors, operates efficiently under a regime of free competition in the retail sector. The Legal Fuel Institute (ICL) emphasizes the importance of maintaining this system, resisting interventions, controls, or price regulations that could be introduced by the proposed National Fuel Distribution Operator. This topic arises at a crucial moment, as a bill is debated in the National Congress, bringing potential changes to the dynamics of the fuel market.
Fuel Monitoring Center: A Proactive Solution
ICL has been advocating for the creation of the Fuel Monitoring Center. This initiative aims to strengthen and expand oversight actions, mainly in the operational aspect, supporting the work of the National Agency of Petroleum (ANP) and consumer protection agencies such as Procon and IPEM. The objective is to enhance oversight and control of fraud, integrating all agencies involved and the significant data volumes in the fuel sector. This integration should align with the fiscal and tax structure at the federal and state levels, facilitating the mapping of information related to the production and blending of fuels and biofuels, and accelerating the process by utilizing current technologies.
Challenges and Potential Benefits
By implementing this centralized monitoring, Brazil may face an adverse scenario that currently results in annual losses of R$ 15 billion due to theft and cargo fraud, adulterations, quality and volume fraud, and illegal operations of gas stations and distributors. “Maintaining free competition and combating irregularities are fundamental for the economic health of the sector and to ensure fair competition and respect for the consumer,” emphasizes Emerson Kapaz, president of ICL.

The Importance of Price Freedom and Healthy Competition
In the last 20 years, since the adoption of the free market in the fuel segment, the sector has become more dynamic and complex, with various players ensuring national supply. “Price freedom is the main driver of balanced competition among energy companies, promoting investments, efficiency, and ensuring consumer respect,” analyzes Kapaz.
Conclusion: Maintaining Balance in the Market
The proposal for the National Fuel Distribution Operator requires careful analysis to ensure that the achievements of free competition are not compromised. The balance between appropriate regulation and the maintenance of a fair competitive environment is crucial for the continuous and sustainable growth of the fuel sector in Brazil.
