Decree published in an extra edition of the Official Gazette of the Union creates a temporary subsidy for producers and importers, conditions payment on fiscal proof of the discount, and expands the compensation package adopted in light of the oil price increase in the Brazilian international market.
Subsidy of R$ 0.44 per liter of gasoline was created by decree of President Luiz Inácio Lula da Silva, published this Monday (25), to reduce the impact of the international oil price increase on fuels in Brazil.
Subsidy is valid for 60 days and depends on fiscal proof
The measure will initially be in effect for 60 days and establishes economic subsidy for producers and importers of petroleum-derived fuels. Under the defined model, the Union will compensate companies for the equivalent value of federal taxes deducted from the gasoline sale price.

Companies will have to join the program and register the discount
Companies wishing to receive compensation will need to formally join the program. They must also prove, through electronic invoices, that the subsidy was deducted from the final price of the marketed fuel.
The decree mandates that the discount value be expressly shown in the fiscal documents. This requirement aims to link public payment to the real application of the discount, preventing the subsidy from being restricted to companies without reaching the sales chain.
After the presentation of declarations by the enabled companies, payment should occur within 30 days, provided the information does not present inconsistencies.
Oil price increase pressured a new round of compensations
The decision is part of the package announced after the escalation of tensions in the Middle East. The scenario compromised the oil flow through the Strait of Hormuz and led the barrel to exceed US$ 100.
In addition to gasoline, the government had already launched compensation measures for diesel, liquefied petroleum gas, aviation kerosene, and credit lines aimed at the aviation sector.
