Courts Authorize Child Support to Be Paid Directly to Adult Children, Without Mother’s Intermediation, in Decisions Aimed at Reducing Family Conflicts.
Many parents believe that when their child turns 18, the obligation to pay child support automatically ends. But the legal reality is different. Majority does not extinguish the duty to provide support, according to a consolidated understanding by the STJ (Summary 358).
What changes is that, upon reaching adulthood, child support ceases to be a presumed right and depends on the proof of the child’s need. It is precisely in this context that a new discussion arises in the courts: to whom should support be paid — still to the mother or directly to the adult child?
Conflicts That Led to Changes in Child Support
In many cases, even after turning 18, parents continue depositing support payments in the mother’s account, who until then was the legal guardian of the minor child. But this creates conflict situations, especially when the young person is already an adult, studies in another city, or has direct expenses that do not go through the mother.

Three-quarters of Brazil have never been mapped with enough precision to know what lies beneath the earth, and experts say there could be a treasure trove of critical minerals and rare earths hidden in regions that no one has even investigated yet.
Many payers complain that the money, at times, was not used for the direct benefit of the child. As a result, courts began to analyze requests for support to be deposited directly into the adult child’s account.
What the Courts Say
Various state courts and the STJ itself have already confirmed that it is possible to authorize direct payment to the adult child, provided it is proven that they have the autonomy to manage their own resources.
- TJ-SP (Civil Appeal No. 1006134-14.2019.8.26.0100): recognized that, after reaching adulthood, the deposit can be made in the child’s account, avoiding friction between parents.
- STJ (AgInt in REsp 1.632.729/RS): highlighted that, given the majority, the recipient is a legitimate party to receive the support payments directly.
- Other rulings reinforce that this measure also ensures more transparency and security in the use of money.
The Impact on Parents and Children
For parents, the change represents psychological and legal relief, as it reduces friction with the ex-spouse and ensures that the amount is directed straight to the child.
For children, it means greater financial autonomy, especially in critical phases like university, when they need to manage housing, transportation, food, and tuition fees.
Cases Where the Change in Child Support Payment Is Not Accepted
Despite the trend, not all cases allow judges to authorize direct payment to the child. The rule applies when:
- The child is already an adult;
- They prove that they still need the support (for example, attending college without an income);
- There is evidence that they are able to manage the funds.
When the child is still a minor, or when there are doubts about their management ability, support continues to be paid to the legal guardian.
How to Request the Change
The parent who wishes to transfer direct payment to the child must file a revision action for child support or request a change in the existing court records.
The judge will evaluate the conditions and may determine the opening of an account in the name of the adult child for receiving the payments.
It is important for the payer not to make the change on their own without judicial authorization, as this can lead to charges for overdue support.
The Logic Behind the Decision
By allowing direct deposits, the judiciary aims to reduce family conflicts and reinforce that the right to support belongs to the child, not the parent managing it.
This change reflects an adaptation of the law to new social realities, recognizing that, upon reaching adulthood, the young person has the right to manage their financial and academic life.
Child Support After Adulthood: Until When Does It Continue?
Even if paid directly to the child, the support is not eternal. The prevailing understanding is that it can be maintained until about 24 years of age, provided the child is attending college or proves real need.
Without this proof, the benefit can be reduced or even judicially extinguished.
Some still criticize the change, arguing that many young people lack the maturity to manage support funds independently. On the other hand, supporters of the measure emphasize that autonomy is part of the maturation process and that intermediation by the mother can prolong unnecessary conflicts between ex-spouses.
Child Support Paid Directly to the Child: A New Scenario in Brazilian Families
The recognition by the courts that support can be paid directly to an adult child represents a significant change in the post-divorce family dynamic.
This decision balances rights and duties, ensures that the amount reaches those who truly need it, and strengthens the idea that adulthood brings not only responsibilities but also financial autonomy.
