The Approved Bill Reinstates the DPVAT as SPVAT, Bringing Crucial Reformulations. Besides Expanding Coverage for Medical and Funeral Expenses, It Imposes a Fine for Non-Payment.
Last Tuesday, (04/09), a bill was approved by the Chamber of Deputies, marking the return of the Personal Injury Insurance for Motor Vehicle Traffic (DPVAT). This insurance, which had been suspended in 2020 during the government of former President Jair Bolsonaro, is known for its role in supporting victims of traffic accidents throughout Brazil. Now, it is to be known as SPVAT.
What Has Changed in the New Bill?
With the approval of the bill, the DPVAT not only returns but also undergoes a substantial reformulation, now being redesignated as Mandatory Insurance for Protection of Traffic Accident Victims (SPVAT).
The bill, approved with a majority of 304 votes in favor against 136, now goes to analysis by the Federal Senate.

If approved without vetoes, it will implement several significant changes.
Among these are the expansion of coverage to include supplementary medical expenses such as physiotherapy, medications not provided by the SUS, and funeral services.
These changes aim to provide broader and more adequate support to the needs of traffic accident victims and their families.
The DPVAT is managed by the Caixa Econômica Federal, with funds collected annually from all vehicle owners.
The amounts paid varied according to the type of vehicle, and the collected amount was intended to compensate accident victims, regardless of responsibility for damages.
What Happens to Those Who Do Not Pay the SPVAT?
One of the novelties brought by the bill is the penalty for vehicle owners who do not make the SPVAT payment.
Failure to pay will result in a fine for serious violation, set at R$ 195.23.
How to File a Claim for the DPVAT?
Regarding compensation, the amount to be granted in each case will be defined by the National Council of Private Insurance (CNSP).
To request compensation, it will be necessary to submit a request accompanied by proof of the accident and the damages caused, or present the death certificate or autopsy issued by the Legal Medical Institute (IML) in more serious cases.
