Changes Involving IPVA, Renewal of CNH, and Social CNH Advance in Congress and May Ease the Budget for Drivers with Different Profiles.

A popular car manufactured in 2005 paid between R$ 400 and R$ 600 in IPVA in Minas Gerais this year. Starting in 2026, this amount will be zero for vehicles that meet the new national criterion.

The rule entered the constitutional text after the approval of a proposal in Congress. The focus is to reduce costs related to car usage and licensing, especially for lower-income families.

In addition to IPVA, there are measures under discussion and already in effect that impact CNH renewal, free digital document issuance, and the creation of Social CNH, directly affecting those who need to drive for work.

What Happened and Why It Caught Attention

Congress approved PEC 72/2023, presented by Senator Cleitinho (Republicanos MG), which addresses the exemption from IPVA for vehicles that are 20 years or older.

The text was approved by the Senate last year and by the Chamber of Deputies earlier this month. The promulgation occurred on December 9, with the transformation into Constitutional Amendment 137.

At the ceremony, the President of the Senate and the National Congress, Davi Alcolumbre, stated that the measure corrects a tax distortion and primarily affects lower-income families, as older vehicles are often used out of necessity.

What Are the Rules, Deadlines, and Conditions

The new rule applies to vehicles that are 20 years or older. This means that the tax will no longer be charged once the vehicle reaches this age.

The exemption covers passenger cars, pickups, mixed-use vehicles, microbuses, buses, trailers, and semi-trailers.

The practical impact can be seen in the example from Minas Gerais. A popular car from 2005 that paid between R$ 400 and R$ 600 this year will have a zero charge in 2026, provided it meets the age criterion.

What Changes in Practice for Drivers in the States

Currently, the IPVA exemption due to vehicle age varies greatly among states. The amendment creates a national parameter based on 20 years of manufacture.

Five states have not yet defined the exemption or adopt stricter rules. Minas Gerais and Pernambuco do not set a vehicle age limit.

Santa Catarina, Tocantins, and Alagoas grant the benefit only for vehicles with longer manufacturing times, applying their own criteria.

With the new rule, the trend is towards standardization of the benefit for vehicles reaching 20 years or older, reducing disparities among the federated units.

How Automatic CNH Renewal Works in Debate

Another measure with the potential to reduce costs is Provisional Measure 1.327/2025, which alters the Brazilian Traffic Code to allow for automatic CNH renewal.

The rule stipulates that this only applies to drivers who have not committed infractions subject to points in the 12 months prior.

The provisional measure is already in effect but requires confirmation by federal deputies and senators to become law. Congress has scheduled an analysis for March 2026.

Who Falls Under and Who Is Excluded from the CNH Rule

According to the text, drivers up to 49 years old will be able to renew their CNH automatically, provided they meet the stipulated requirements.

Drivers between 50 and 69 years would only be entitled to the benefit once. Drivers aged 70 or older are excluded from the rule.

The proposal also guarantees free digital CNH, keeping the physical document optional. In either format, the CNH remains valid as an official identification document throughout the country.

Social CNH, Toxicological Testing, and Practical Lessons at the Center of the Debate

Congress approved PL 3.965/2021, which creates the Social CNH. The initiative allocates part of the revenues collected from traffic fines to cover the cost of driver’s licenses for low-income individuals.

The proposal was sanctioned in June and became Law 15.153 of 2025. The text also establishes rules for the electronic transfer of vehicles and adjusts the requirement for toxicological testing in obtaining the CNH.

The rule states that candidates for their first license in categories A and B, aimed at motorcycles and cars, must present a negative toxicological test. The requirement already existed for categories C, D, and E, related to freight and public transport vehicles. A survey by Ipec, conducted in February 2025, indicates that 83% of Brazilians support making the test mandatory.
