Labor Commission Approves Bill That Amends Law 7.998/90, Creates Scaled Rules for Unemployment Insurance for Seasonal Rural Workers, Limits Requests to Once a Year, and Provides for Up to Three Installments According to the Duration of the Harvest Contract
The Labor Commission of the Chamber of Deputies approved a bill that ensures the payment of unemployment insurance to seasonal rural workers by amending Law 7.998/90, with scaled rules according to the length of the contract and a direct impact on protection during off-seasons.
The approved proposal corresponds to the substitute presented by the rapporteur, Deputy Ricardo Maia (MDB-BA), to Bill 714/19, authored by former Deputy Marília Arraes (PE), maintaining the central objectives of the original initiative.
According to Ricardo Maia, the merits of the proposal are undeniable, as seasonal workers face seasonality and economic vulnerability, with formal employment restricted to certain times of the year, making continuous access to income and social protection difficult.

Rules for Granting the Benefit
According to the approved text, unemployment insurance will be granted in a scaled manner, according to the length of service provided under the harvest contract, respecting all requirements established in current legislation.
A worker who has worked for a period exceeding two and up to four months will be entitled to two installments of the benefit, according to the criteria defined in the new text approved by the commission.
Three installments of unemployment insurance will be granted when the harvest contract exceeds four months, respecting the maximum limit of six months for formal employment.
Once all legal requirements have been met, the benefit may be requested only once a year, preventing the accumulation of requests in the same fiscal year and reinforcing program control.
Objective of the Measure and Processing
According to Marília Arraes, the measure aims to ensure financial protection for seasonal rural workers during off-season periods when the availability of formal work in the field drastically decreases.
The project is being processed conclusively and will be reviewed by the Finance and Taxation, and the Constitution, Justice, and Citizenship committees before moving on to the final vote.
To become law, the text must be approved by the Chamber of Deputies and the Federal Senate, concluding the legislative process.
