Law sanctioned in Piauí now requires companies contracted by the state to reserve job vacancies for ex-prisoners and people serving sentences in semi-open and open regimes or on parole. The measure was signed by Rafael Fonteles and published in the State Official Gazette on Friday (3).
How the job reservation will work
The rule applies to administrative contracts that require labor. When the service requires 25 or more workers, the company must reserve at least 5% of the vacancies for this group.
In contracts with six to 24 workers, at least one vacancy must be reserved. In contracts with up to five workers, the adoption of the measure will be optional.

The law also stipulates that when the calculation results in a fractional number, the total must be rounded up. Thus, the reservation should consider the next closest whole number.
Hiring will have salary and labor rules
Hired workers must follow labor legislation. The text also establishes that the work will be remunerated and cannot be less than the minimum wage.
The state obligation applies to public or private companies contracted by the state, directly or through bidding. The rule covers direct administration, autonomous agencies, and foundations, as well as the Legislative, Judiciary, Public Prosecutor’s Office, and Court of Accounts.
Selection will be made by social offices
The positions must be filled after pre-selection and referral of candidates by the state’s social offices, according to the resolution of the National Justice Council.
If there are no candidates with the required profile for the position, the reserved positions may be reverted to other workers. In case of dismissal or impediment, the company will have up to five days to inform the competent bodies and allow replacement by another worker under the same conditions.
Notices must foresee the obligation
The requirement must appear explicitly in the bidding notices and contracts. Before each payment, companies will need to prove to the public administration that they are fulfilling the job reservation provided for in the rule.
The measure will only apply to bids whose notices are published 90 days after the sanction. If any additional regulation is necessary, it must be done within 60 days.
The rule also authorizes actions for professional training, continuing education, vocational courses, documentation regularization, and strengthening of family ties for beneficiaries. The sanction occurred one day before the start of the electoral ban, a period that imposes restrictions on governors running for re-election.
