Turnaround in New Traffic Law Confirms the Return of Fines Feared by Drivers in 2024
If you are a driver in categories C, D, or E, it’s good to stay alert! The turnaround in the new traffic law of 2024 brought back a feared fine that had been suspended since September 2022. This refers to the penalty associated with the toxicological test, which is now mandatory again and carries heavy consequences for those who do not comply with the new rules.
In June 2023, the President of the Republic, Luiz Inácio Lula da Silva (PT), signed Federal Law 14.599/23, which amends the Brazilian Traffic Code (CTB) and reinstates the mandatory toxicological test for drivers in categories C, D, and E. With the new traffic law in effect, those who do not take the test every two and a half years or let it expire will commit a serious infraction, subject to a feared fine that can significantly impact drivers’ finances.
New Traffic Law Returns
This penalty, which had been suspended since 2022, has returned with full force and is already in effect. Drivers who do not comply with the new traffic law may face a feared fine of R$ 1,467.35, in addition to 7 points added to their National Driver’s License (CNH). And it doesn’t end there: in case of recurrence within 12 months, the fine can be multiplied, reaching the amount of R$ 2,934.70, in addition to the suspension of the right to drive for three months.

Objective of the New Rule

The two and a half years count starts from the acquisition or renewal of the CNH, regardless of when other exams were conducted. Therefore, those with an expired or soon-to-expire license need to pay extra attention.
Truck and Bus Drivers are the Most Affected by the Fine
Truck and bus drivers, who fall into the mentioned categories, are the most impacted by the feared fine. Those who carry out paid activity with the vehicle (EAR) and do not prove the execution of the periodic toxicological test during the renewal of the CNH are also subject to the same strict penalties.
The new traffic law reinforces the necessity of keeping up with obligations, not only to avoid fines but also to ensure everyone’s safety on the roads. Therefore, if you fall under categories C, D, or E, do not forget to take the toxicological test within the stipulated timeframe to avoid unpleasant and heavy surprises in your wallet.

Mas também penso que para ser político tem que fazer exame toxicológico a cada seis meses.
