Energy Distributors Want 70% Market Reserve Through PL 4831 Solar Taxation, Leaving Entrepreneurs and Solar Energy System Installers Concerned.

End of Solar Energy? Energy distributors are now demanding, through the PL 4831, a 70% market reserve. This was the information released in recent days that caused significant repercussions. However, this solar taxation project is not new, having been introduced since mid-last year, and a request for urgent status has now been made.

Understand How PL 4831 Benefits Energy Distributors

It is in the interest of energy distributors to hold 70% of the market; in other words, companies want, with PL 4831 solar taxation, that 70% of electricity users do not have the right to install a solar energy system and consume their own generation, with only 30% having that right.

Once 30% of customers have photovoltaic systems, energy distributors will deny any installation access requests. Currently, we have approximately 8% of users with solar energy, which translates to about 12 million projects that have already been installed. So when it reaches 30%, the goal of PL 4831 would supposedly end the solar installation sector.

Thus, the market would allow installations only until a maximum of 2028, and thereafter, energy distributors would prohibit installations to ensure this 70% reserve.

About 70% of users will continue to be captive, buying 100% from distributors and not able to make any installations. Industry experts regarding PL 4831 solar taxation assert with full certainty that nothing will happen to the segment, even though the governments in general may not be very supportive and align with the energy distributors.

Experts Assert That PL Cannot Harm the Solar Energy Sector

In 2019, when the solar taxation began, there was the same concern that the solar energy sector would end, yet we have reached 2025 even with the taxation. There was an agreement that was favorable for the distributors and not so good for consumers, but it was not enough to ‘kill the sector’, which continues to thrive.

The market has been carrying out various installations throughout the country. According to experts, assuming that PL 4831 solar taxation is approved, it will need to undergo changes.

Experts point out that the project will likely undergo modifications during its progress to reconcile the interests of different parties involved, such as the government, energy distributors, and the distributed generation sector, which includes solar energy.

These changes could mitigate the negative impact highlighted by critics of the project, such as restricting the growth of solar DG. In summary, many of those defending will not accept 70%, but it is uncertain how many percent will remain in the end.

Why Solar Taxation Cannot Negatively Impact the Sector?

Even if energy distributors achieve a percentage from solar taxation, the solar energy sector will not be affected, as we will never manage to adopt 100% of energy users.

Not everyone can acquire solar energy systems on their rooftops for various reasons, the main one being lack of roof space; the vast majority of the population has available land for installation and remote generation, which is not very worthwhile.

This market reserve that the utility company is demanding will exist regardless of whether PL 4831 is approved or not, because not everyone will install solar energy. Therefore, experts assert that entrepreneurs and installers should not be concerned about the approval of the bill.
