Recent Initiatives Aim To Ensure That Fuel Is Essential And Accessible To All Brazilians, And The Legal Fuel Institute Is At The Center Of This Mission.
The Legal Fuel Institute (ICL) enthusiastically celebrates the recent approval of PLP 136/2023 by the Senate, which categorizes fuel as a fundamental good for Brazilian society. Led by Senator Veneziano Vital do Rêgo, the project aims to consolidate and expand previously established guidelines, ensuring that essential resources remain accessible.
Compensations And Benefits
This legislation emphasizes the prior commitment established in Complementary Law 194 of 2022. It ensures that items such as fuels, electricity, and public transport remain a priority. The measure also provides for a significant compensation of R$ 27 billion from the Union to states and the Federal District, due to revenue losses resulting from reductions in ICMS on fuels.
“We value Senator Vital do Rêgo’s tireless efforts in advocating for fuels as essential. We believe that hydrated ethanol should also be recognized as such”, says Emerson Kapaz, leader of the ICL.

Toward Tax Simplification
The ICL is focused on strengthening the single phase for all fuel products. “Simplicity is crucial. We have already faced a mountain of tax rules. The single phase, by unifying taxes on production and imports, promotes fair competition and reduces the risk of illegal practices”, explains Kapaz.
In addition to supporting equality, the single-phase system for hydrated ethanol would effectively combat tax evasion, as this product has a complex taxation structure.
Developing Stronger Laws
To effectively combat fraud, we need robust laws. “It is crucial to pass laws that tackle pipeline theft, cargo theft, and illegal practices related to fuels“, insists Kapaz. The ICL also advocates for greater oversight of gas stations that use fraudulent technologies, harming consumers.
“Illegal operations will only cease with strict laws and effective penalties”, emphasizes Kapaz.
Joining Forces For Supervision
The ICL highlights the need for permanent task forces for assertive inspections. With collaboration among various agencies, we can identify and combat illegal practices more efficiently.
With support for a monitoring center coordinated by the Ministries of Mines and Energy and Finance, the ICL believes that the country will be better prepared to face and prevent new illicit activities in the future.
