The Government Implemented Changes to the Anniversary Withdrawal of FGTS, Restricting the Amount of Operations Per Year, the Deadlines for Anticipation, and the Maximum Amount Available, in an Attempt to Balance Worker Access and the Sustainability of the Guarantee Fund.
The new guidelines for the anniversary withdrawal of FGTS came into effect on November 1st and profoundly change the way workers can manage their resources. The measure establishes stricter restrictions on the number of simultaneous operations and reduces the maximum amount that can be anticipated. The goal is to curb the excessive use of this modality as personal credit and preserve the fund’s original function as a safety reserve and social investment.
The Curatorship Council of FGTS unanimously approved the new rules after finding that the current model was undermining the fund and blocking billions in accounts of dismissed workers. The changes directly affect around 13 million people, who will now need to observe annual limits and new intervals between one operation and another.
Intervals and Limits of Operations Per Worker
The new model requires those who adhere to the anniversary withdrawal of FGTS to wait 90 days before making the first operation.

From now on, each worker will be able to make only one anticipation operation per year, changing the credit dynamics that had been established since 2020.
The maximum limit of simultaneous anticipations has been reduced from eight to five.
This restriction aims to prevent account balances from being completely compromised, reducing the risk of indebtedness and ensuring that part of the resource continues to generate returns within the fund.
New Value Limits for Anticipation
Another important change is the value ceiling. Previously, it was possible to anticipate almost the entire available balance in FGTS.
With the new rule, the limit for anniversary withdrawal of FGTS is R$ 500 per year, with a minimum value of R$ 100.
Thus, the worker can anticipate up to five annual installments, totaling a maximum of R$ 2,500 in operations within a 12-month period.
This measure aims to curb the use of the fund as a line of credit and preserve the liquidity of the system.
The Ministry of Labor and Employment estimates that, with the new model, around R$ 84.6 billion will no longer be directed to banks and will be returned directly to workers by 2030.
Sustainability and Protection of the Fund
According to the Minister of Labor and Employment, Luiz Marinho, the anniversary withdrawal of FGTS has been becoming a “trap” for workers, who lose the right to withdraw the total amount in case of dismissal.
Currently, there are R$ 6.5 billion blocked in accounts of those who have been terminated and could not access their own resources.
The government assesses that strengthening FGTS is essential to ensure investments in structural areas such as housing, sanitation, and infrastructure that depend on the fund’s resources.
The new rules, therefore, seek to reconcile individual access to money with the preservation of the social and economic role of the system.
What Changes for the Worker
In practice, the worker who has already adhered to the anniversary withdrawal of FGTS will continue to have the right to the annual withdrawal, but with limited amounts and mandatory intervals.
Those who choose this modality from now on will need to plan the use of their balance in advance, as it will not be possible to resort to anticipation with the same frequency as before.
Financial institutions will also need to adapt, restructuring contracts and reducing the credit offer based on FGTS balances.
For the government, the new model reinforces the savings aspect of the Fund, preventing it from becoming a source of indebtedness for the population.
