The Brazilian social security legislation provides for a 25% increase on the pension due to permanent disability for insured individuals who prove the need for permanent assistance from another person in daily activities.

The benefit is established in Article 45 of Law 8.213 of 1991 and remains valid after the social security reform.

The Supreme Court determined that the additional is restricted to this type of pension, an understanding that maintains the actuarial balance of the system, according to the Court.

Who Is Entitled to the 25% Additional

The increase is intended exclusively for beneficiaries of the General Social Security Scheme who receive a pension due to permanent disability and prove, through a medical examination, continuous dependence on a caregiver.

The diagnosis of a severe illness alone does not guarantee the right.

The main criterion is the functional limitation that prevents the insured from autonomously performing tasks such as movement, hygiene, and feeding.

The analysis is individual and based on reports and medical assessments, and may include evaluation of the home environment.

After accessing, the insured should locate the service “Request 25% Increase,” fill in the data, and attach the medical documentation that proves the dependence on a caregiver.

The INSS then schedules a medical examination, either in-person or documentary, to evaluate the request.

It is also possible to make the request by phone 135, with subsequent submission of documents and examination as instructed by the service.

When Is the Additional Paid and When Can It Be Terminated

The 25% increase is due from the date of the request, provided that the need for assistance is proven.

The amount is readjusted by the same indices as the main benefit and may exceed the social security ceiling, as provided for in the legislation.

Payment is terminated in the event of death of the pensioner or if the examination finds that functional capacity has recovered to eliminate the need for a caregiver.

The additional is not transferable to dependents in the case of death pension.

If the Need Arises After Retirement

The insured can request the additional even after the granting of retirement if the condition of dependence arises later.

The standardization also contributes to greater legal security, both for citizens and for the public administration.

Purpose and Financial Impact of the Additional
