TJPE denied compensation to young woman attacked by shark at Piedade Beach and pointed out known risk in the Jaboatão dos Guararapes area.
On June 3, 2026, the first-instance decision of the Pernambuco Court of Justice (TJPE) was made public, denying the compensation request made by Kaylanne Timóteo Freitas, a young woman who lost her left arm after being attacked by a shark on March 6, 2023, at Piedade Beach, in Jaboatão dos Guararapes, in the Metropolitan Region of Recife.
The lawsuit sought compensation for moral, aesthetic, and material damages against the State of Pernambuco and the Municipality of Jaboatão dos Guararapes. The sentence, signed by Judge Juliana Rodrigues Barbosa, deemed the request unfounded, understanding that the risk in the area was notorious, known for decades, and sufficiently signposted, thus dismissing the civil liability of the public authorities.
Shark attack occurred in March 2023 at Piedade Beach and ended with the amputation of the young woman’s left arm
Kaylanne was 15 years old when she was attacked by a shark while swimming at Piedade Beach, in Jaboatão dos Guararapes. The incident occurred on March 6, 2023, a day after another teenager was bitten in the same region of Igrejinha de Piedade.

The injuries caused by the attack were severe and resulted in the amputation of the young woman’s left arm. At the time, the case had significant repercussions in Pernambuco for occurring in an area already known for its history of shark-related incidents.
According to reports published after the episode, Kaylanne was rescued by lifeguards and taken to the Hospital da Restauração by a team from the Mobile Emergency Care Service.
Defense alleged omission by the State and the Municipality in monitoring and signaling the area
In the lawsuit, the young woman’s defense argued that there was an omission by public entities in preventing the accident. The central argument was that the attack occurred in a section considered safe for swimming and that the signage at the specific point was not sufficient to prevent bathers from entering the sea.
It was also pointed out that there was an alleged failure in the continuity of public policies for shark monitoring in the region. The defense claimed that the interruption or weakness of these actions contributed to increasing the risk to beachgoers.
The request included compensation for moral, material, and aesthetic damages, considering the severity of the physical and psychological consequences suffered by the young woman after the attack.
State and municipality argued that the risk of attack was known and there were warning signs on the shore
The State of Pernambuco and the Municipality of Jaboatão dos Guararapes denied responsibility for the episode. The thesis presented by the public entities was that the risk of shark attack in that stretch of the coast has been widely known by the population for more than 30 years.

According to the decision, there were warning signs spread along the shore alerting about the presence of sharks and the risks of swimming in certain areas. For the Justice, this signage was sufficient to characterize the fulfillment of the duty to inform.
The sentence also considered that there was no direct causal link between the public authority’s actions and the attack suffered by Kaylanne, treating the episode as resulting from a known natural risk in the area.
Sentence pointed to “exclusive fault of the victim” and stated that she assumed the risk by entering the sea
The strongest point of the decision was the recognition of the so-called exclusive fault of the victim. According to the magistrate, by choosing to swim in a notoriously risky area, Kaylanne would have voluntarily assumed the danger associated with the location.
The sentence stated that shark incidents at Piedade Beach and nearby areas have been public knowledge for decades. Therefore, the judge understood that the state’s duty to inform was fulfilled and that it would not be appropriate to hold the State or the municipality responsible for the attack.
With this understanding, the compensation request was judged unfounded in the first instance. However, the case may still continue in discussion in the TJPE itself through an appeal.
Piedade Beach returned to the center of the debate on shark attacks in Pernambuco
Piedade Beach is one of the areas most associated with shark attacks on the Pernambuco coast. The stretch near the Igrejinha de Piedade has appeared in different surveys and reports as one of the regions of greatest attention for bathers and local authorities.
In March 2023, the attack on Kaylanne occurred during a period of high alert. The day before, another teenager, Claudemir Gleybson Ferreira Herculano, 14, had been bitten by a shark about 500 meters from the spot where the young woman was attacked.
This history reinforced, in the court decision, the idea that the risk was neither unknown nor unpredictable for those who frequented the area.
Decision reignites discussion about the extent of public authority’s responsibility in natural risk areas
The case raises a sensitive legal discussion: should the public authority compensate victims of wild animal attacks in natural areas when there are warning signs and a public history of risk?
For the first instance of the TJPE, the answer was negative in this specific case. The decision understood that the existence of warnings and the notoriety of the risk removed the civil liability of the State and the municipality.
At the same time, the case’s repercussion keeps the debate open about the sufficiency of signage, the need for continuous monitoring, and the role of authorities on beaches with a recurring history of incidents.
After the attack, Kaylanne began to rebuild her life also through Paralympic sports
After the attack, Kaylanne went through a process of physical and emotional adaptation. Reports on the case indicate that she became involved in Paralympic sports and participated in competitions promoted by the Brazilian Paralympic Committee.
The young woman’s journey gained prominence for showing an attempt at reconstruction after a serious and definitive episode. The legal dispute, however, continues as a second front of the story, now centered on the public authority’s responsibility and the limits of prevention in natural risk areas.
The decision does not end the public discussion. On a coastline marked by warning signs, recorded attacks, and bathers who continue to enter the sea, Kaylanne’s case raises a difficult question: when the risk is known to all, who should be held accountable for the consequences?
