The law that allows Rio de Janeiro to impose administrative penalties on individuals or legal entities that steal, burglarize, or receive fuel or pipelines was signed by the acting governor of RJ, Cláudio Castro (PSC). The signed bill had already been approved last month by the Legislative Assembly and also includes the closure of establishments involved in illegal practices and cancellation of registration in the ICMS registry, as well as other sanctions already established in the criminal sphere.

The legislation also guarantees the possibility of cancellation of establishments’ registration in the ICMS registry.

Partners of companies involved in theft, burglary, or receiving stolen fuel may also lose their privileges for at least five years. The applicable fines range from R$ 36 thousand to R$ 18 million.

The new law also provides that fuel seized in Rio de Janeiro be used to supply police vehicles and the Fire Department. During the covid-19 pandemic, however, the fuel will be primarily allocated to ambulances and generators in public hospitals.

The Brazilian Institute of Oil (IBP) viewed the law’s signing positively. “The mobilization of government agencies, civil society, and sector companies in the search for integrated solutions is essential to contain the escalation and funding of organized crime and reduce the risks of large-scale accidents,” it argued.
