The sanctioned bill had already been approved last month by the Legislative Assembly and also includes the interdiction of establishments involved in illegal practices and the cancellation of registration in the ICMS register, in addition to other sanctions already established in the criminal sphere.

The legislation also guarantees the possibility of canceling the registration in the ICMS register of the establishments.

Partners of companies involved in theft, theft or reception of fuel may also lose their prerogatives for at least five years. The applicable fines vary between R$36 and R$18 million.

The new law also provides that fuel seized in Rio de Janeiro will be used to supply police vehicles and the Fire Department. During the covid-19 pandemic, however, fuel will be given priority to ambulances and generators installed in public hospitals.

The Brazilian Petroleum Institute (IBP) considered the enactment of the law to be positive. “The mobilization of government bodies, civil society and companies in the sector in the search for integrated solutions is essential to contain the escalation and financing of organized crime and reduce the risks of large-scale accidents”, he defended.
