New Operational Data Platform for Judges Promises to Reduce Litigation in Air Transport and Provide Predictability to the Sector
The federal government, through the National Civil Aviation Agency (Anac), the National Justice Council (CNJ), and the Ministry of Ports and Airports (MPor), announced in February 2026 the creation of InfoVoo for Delays and Cancellations.
According to the authorities, Brazil accounts for only 3% of global aviation, but leads the ranking of lawsuits against airlines. The goal is to reduce litigation, speed up decisions, and return legal certainty to the sector, which is currently pressured by unpredictable costs.
With restricted access for judges and authorized staff, InfoVoo integrates records from airports and control systems to reconstruct the history of each operation. The promise is to reduce doubts about the causes of events and guide correct accountability.

The MPor informed that access will be limited to magistrates and authorized staff, preserving sensitive data. The consultation standardizes technical evidence and reduces factual discrepancies that inflate litigation.

Detailed Operational Data for Faster Decisions
InfoVoo gathers information such as operational flow, departure time, origin, and weather conditions. It also shows the expected and actual departure times and records occurrences noted at the airport, creating a technical snapshot of the flight.
According to Viviane Rebello, this consolidation helps identify when there was force majeure, operational failure, or external event. By reducing factual controversies, Justice can pacify conflicts with greater speed and predictability.
What the InfoVoo Report Shows
Among the available fields are flight chronology, origin and destination, weather conditions, scheduled and actual takeoff times, and formal notes from the airport. The set provides an objective basis to assess whether assistance, rebooking, reimbursement, or compensation is warranted.
Less Litigation Can Mean Cheaper Tickets
For Faierstein, a representative of the regulator mentioned in the announcement, the high volume of lawsuits in Brazil generates legal uncertainty and deters potential entrants. Predictability is key to efficiently planning fleet, network, and tariffs.

The collegiate board of Anac approved the revision of Resolution No. 400, which governs regular air transport in the country. The update seeks to make information clearer to the passenger and align the assistance provided by airlines with the Brazilian Aeronautics Code (CBAer).
The text reinforces that passengers have the right to material assistance in cases of delays and cancellations, regardless of the reason. At the same time, it clarifies instances of civil liability, excluding force majeure situations, such as adverse weather, which are beyond the control of companies.
According to Anac, making rules and procedures explicit protects the consumer and the legal stability of the sector. Making expectations transparent reduces disputes and can attract new airlines to operate in Brazil.
