Irresponsible Driving May Result in a Fine of R$ 3 Thousand and Suspension of the CNH for One Year for Offending Drivers
With the goal of making Brazilian traffic safer, the Federal Senate is analyzing a new bill that promises to change the rules for serious traffic violations in the Brazilian Traffic Code (CTB), raising the fine amount significantly.
This Bill 1405/24, presented by Deputy Clodoaldo Magalhães (PV-PE), aims to introduce stricter evaluations for drivers who engage in dangerous maneuvers, especially overtaking in high-risk situations.
Fine – What Is at Stake with the New Law?
Dangerous overtaking is a significant problem on Brazilian roads. According to the National Department of Transportation (DENATRAN), by July 2024, there were about 2 million violations of this type recorded.

Imagine a common situation: you’re driving peacefully on a double lane road when suddenly a car appears, overtaking in a curve where visibility is minimal. Situations like this not only put those involved at risk but also everyone around.
This type of maneuver, if the bill is approved, will be classified as a serious violation, which implies harsher penalties for offenders. Deputy Clodoaldo’s proposal aims precisely to curb this dangerous practice. According to him, these overtakes in inappropriate places, such as curves and inclines, where the risk of complications is greater, have a direct impact on the increase in fatal accidents.
What Will Be the Penalties?
The punishments outlined in the bill are rules. If approved, a caught driver performing a dangerous overtaking may be penalized with a fine equivalent to ten times the value of a serious violation, that is, R$ 2,934.70. Additionally, you will have your National Driver’s License (CNH) suspended for 12 months, with the addition of seven points on the CNH.
And the message is clear: if the driver disrespects the suspension and is caught driving, the suspension period will double, intensifying the protection.
Impact on Traffic Safety
But, after all, how can we support that laws have really improved safety? The expectation is that yes, this will occur. With higher fines and stricter punishments, the proposal aims to act preventively, encouraging more prudent behaviors. Think of a child who learns early the importance of waiting for the signal to change before crossing the street.
When we reinforce good practices, we create a culture of responsibility. Likewise, with severe penalties for serious violations, it is expected that most drivers will feel compelled to respect traffic rules, reducing cases of accidents caused by reckless overtakes.
The Path to Approval
The bill still needs to go through several stages before becoming a reality. Currently, it is under discussion in the Committee on Transportation and Traffic (CVT). If approved by this committee, it will proceed to a vote in Congress.
After passing through the Chamber of Deputies and the Federal Senate, the bill needs to be approved by both houses of the Legislature. With the approval, it goes to the President of the Republic, who decides on the sanction. Although it follows a clear sequence, the process has no defined deadlines, which brings uncertainties about how long it may take for the bill to come into effect, if approved.
If sanctioned, there will be a period of adaptation for drivers and traffic agencies to adjust to the new rules. In this process, educational campaigns should play a crucial role, helping the population understand the changes and their impact on daily life.
